Ord 086-2001 9/11/2001ORDINANCE NO. 86 -2001 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, DECLARING DISASTER EMERGENCY IN THE CITY; PROMULGATING MAXIMUM RETAIL PRICES FOR CERTAIN GOODS AND SERVICES IN THE CITY; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. It is hereby declared that a state of disaster emergency exists in the City of Wichita Falls because of the terrorist attacks in New York City, Washington, D.C., and other areas of the United States of America of September 11, 2001. SECTION 2. Finding that there has been a substantial disruption of the local free, competitive market in the purchase or sale of the hereinafter described goods and services, there is hereby set as the maximum retail price for the hereinafter described goods and services, the price charged by the seller of such goods or services in the city limits of Wichita Falls on September 11, 2001, before 8:00 a.m. Central Standard Time, to -wit: 1. Groceries, beverages, toilet articles and ice; 2. Construction and building materials and supplies, electrical and gas generating and transmission equipment, parts and accessories; 3. Charcoal, briquettes, matches, candles, lamp illumination and heat unit - carbides, dry batteries, light bulbs, flashlights and hand lanterns; 4. Hand tools (manual and power), earth - moving equipment and machinery, automotive parts, supplies and accessories; 5. Apartment, duplex, multi - family dwelling, rooming house, hotel and motel rentals, insofar as such regulations are not inconsistent with laws concerning federally insured housing units; 6. Gasolines, diesel oils, motor oils, kerosenes, grease and automotive lubricants; 7. Restaurant, cafeteria and boarding -house meals; 8. Medicines, pharmaceuticals, medical instruments, equipment and supplies; 9. Blankets, quilts, bedspreads, bed linens, mattresses, bedsprings, 9. Blankets, quilts, bedspreads, bed linens, mattresses, bedsprings, bedsteads, towels and toilet paper. SECTION 3. Anyone convicted of violating this ordinance shall be subject to a fine not exceeding Five Hundred ($500.00) Dollars. Each sale to a different consumer of any goods or services included in Section 2 shall be considered a separate offense. SECTION 4. This ordinance is declared to be an emergency measure because of the acts of terrorism in the United States of America, and the resulting declaration of emergency by the City of Wichita Falls, County of Wichita, and it shall become effective immediately upon its passage. SECTION 5. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law.
