ON EACH DAY; PROVIDING IT SHALL NOT APPLY TO PERSONS., FIRMS AND CORPORATIONS ENGAGED IN THLTL' SALE OF BEER) AS A PRINCIPAL BUSINESS, AND '�,FIICH IS TO BE CONSTT.'1ED ON THE PREMISES;+PRESCRIBING A PENALTY., --- 1_� BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS., TEXAS. SECTION 1. That it shall hereafter be unlawful for any person, firm or corporation engaged in the sale of beer in connection with a cafe., sandwich stand or other similar business to be drunk on or off the premises in the City of Wichita Falls, and not as the principal business., and outside of the followinG described territory in said city, to-wit: Beginning at Wichita Valley R.R. Track at Thirteenth Street; Thence runnin'fT north with the I'lichita Valley R.R. Track connecting with the -�ort vv'orth & Denver R.R. Track; Thence running north with the Fort Worth & Denver R.R. Track to Third Street; Thence West on Third Street to Scott Street; Thence South on Scott Avenue to Sixth Street; Thence West on Sixth Street to alley between Travis and Austin Streets; Thence South on alley to Eleventh Street; Thence East on Eleventh Street to Travis Street; Thence South on Travis Street to Thirteenth Street; Thence East on Thirteenth Street to 1;iichita Valley R.R. Track to place of beginning; To keep said place of business open or sell beer or other commodities from such place of business between the hours of twelve ( 12) otclock midnight and five ( 5) o' clock A.Ivi. of each day. SECTION 2. Any person, firm or corporation, his, it or its agents, servants, or employees, who shall violate this Ordinance, shall upon conviction in a court of proper jurisdiction, be fined not less than twenty five (�,,'25) dollars,, nor- more than two hundred ($200) dollars; each and every hour that such place of business is kept open shall constitute a separate offense, and each and every sale of beer or other corff-,iodities durin,� such prohibited hours shall constitute a separate offense. SECTION 3. This ordinance shall not apply to persons, firms and corDorations engaged in the sale of beer as a principal business, and which is to be consumed on the premises. The cafes, sandwich stands and other similar businesses which are regulated by this ordi- nance are places of business where beer is sold in connection with the principal business, and the principal business is not the sale of beer, which is to be consumed on the premises.
