BE IT ORDAIM BY 7ia" BOARD OF ALEET-4,1EN OF MEM CITY CF WICHITA FALLS, TEXAS, as follows: SECTiON lo That there shall be submitted to the qualified voters of the 1,ity of Wichita i1alls, Texas, the cuestion of making the following amend- ments to the charter of said City: Amendment No. 1 : "That Section 74 of the present charter of the city of Wichita Falls be amended so as to read as follows: tAmended Section ?4. The Board of Aldemen shall havethe power to levy and collect an annual tax, not exceeding two per cent of the property values within said city for all purposes, conmencing with the year 1920 and annually thereafter, and the purposes for which said tax may be levied shall be as follows: (a) An annual tax not exceeding sixty cents on each one hundred dollars of the assessed value of alli-roperty within the limits of said city subject to taxation for state and county purposes may be levied and collected for current expenses and for general improvements of the city and its property, to be known as the General Fund. (b) An annual tax, not exceeding twelve cents on each one hundred dollars of the assessed value of all property within the limits of said city subject to taxation for state and county purposes, may be levied and collected for current expenses in maintaining, improving and beautifying public parks and ceme- teries and maintaining and improving public playgrounds, and to be known as the Park Fund. (c) An annual tax of fifteen cents on each one hundred dollars of the assessed value of all property within the limits of said city subject to taxation for state and county purposes, may be annually levied and collected for the purpose of laying out, opening, constructing, repairing and impraving the roads, bridges, and streets within the limits of said city, and to be known as the Street Fund. (d) An annual tax, not exceeding three cents on each one hundred dollars of the assessed value of all property within the limits of said city subject to taxation for state and county purposes, may be levied and collected for current expenses for the purpose of establishing, providing, maintaining and operating a public library, or libraries within said city, to be known as the Library Fund* (e) An annual tax, not exceeding one dollar and ten cents on each one hundred dollars of the assessed value -of all property within the limits of said City subject to taxation for state and county purposes, may be annually levied$ assessed and collected for the purpose of paying interest and p3�oviding a sinking fund for the redemption of all bonds heretofore or here- after legally issued by the said City,t And that upon the adoption of the aforesaid Amended Section 74* the present Section 74 shall be repealed and mended Section ?4 substituted in lieu thereof*" Amendment No. 2: "That Section 75 of the present charter of the City of Wichita Falls be amended so as to read as follows: t.Uiended Section 75. The Board of A ldermen shall have authority by ordinance to raise money on the credit of the city for the special and definite purposes hereinafter set out by issuing bonds of the city or otheri.&Tise, provided the bonded debt of the city shall only be increased by consent of a majority of the qualified voters of said city who are property taxpayers voting at said election. Such election shall be ordered by the Board of Aldermen and notice thereof shall be given for at least thirty days by the Mayor, by publication in some daily newspaper published in the city at least once a week for three consecutive weeks, or for ten days in a daily paper next and preced- ing such election, provided that whatever power the Board of JUdermen may have possessed or acquired under the incorporation laws now in force in said City prior to the adoption of this Charter, through any election held under such law to increase the bonded indebtedness of said city, is hereby continued and perpetuated in said Board of Alder- ment and may be exercised under this Charter with the same effect that such town might have had or exercised under said incorporation lawst if this Charter had not been adopted, and providing further that the foregoing provisions requiring an election to be held shall not apply to funding bonds issued or to be issued on any vali(l, outstandinig bonds of the City of 7Vichita Falls, nor to any bond issue when for a sum lessthan i�vo Tlaousand Dollars 000,00) and when issued for the pur- poses of repairing- buildings or structures for the building of which bonds are allowed to be issued. The purposes for which bonds may be issued are as follows: 1. For the purpose of acquiring public parks, playgrounds or cemeteries under the provisions of this charter, 2, For the Purpose of constructing and repairing public buildings, making permanent street improvments, or constructing storm or sanitary sewers, or constructing public market house or houses and municipal abbatoirs. The proceeds of bonds issued for street improvements may be loaned by the city at six per cent interest, payable annually, to property owners against the cost of paving or other improvements, the principal to be paid in not to exceed ten annual installments. The payment of said funds to be properly secured by lien on the property against which sEdd improvements are assessed or other property, in such manner as may be provided by general ordinance. The ordinance authorizing the issuance of any bonds shall state fully the purpose for -v,,:hich same are issued and it shall be unlawful for any officer or officer to dilvert or permit to be di- verted any funds Sfcqthe Purposes stated in said ordinance and the publicationof notice of election. 3, For the purpose of acquiring and constructing waterworks providing an adeauate and available water supply and plant for said city, End acquiring and constructing an electric light and power plant within or without said city; to furnish light and power to said. city for any and all municipal purposes, including the fur- nishing of all such light and power to the inhabitants thereof* 4. For the purpose of refunding any or all of the outstand- ing bonds of the City, including judgments, rendered against the City on its bonds, and including in one or more series of refund- ing bonds any or all of the outstanding bonds of the City regard- less of the issue, purpose or rate of interest of such original bonds; provided, refunding bonds shall not bear interest at a rate exceeding the rate borne by bonds refunded, No bonds for any purpose shall be issued which shall, when added to all outstanding bonds, be of greater amount than the annual tax herein authorized according to the last assessnent rolls of the City will pay t�e interest on and create a sinking fund sufficient to pay the principal at maturity, All bonds issued shall be signed by the Y ayor countersigned by the City Clerk I . and sealed with the seal of the city and shall be payable at such times as may be fixed, not more than forty years from their dates. The Official signatures may be litho- graphed on interest coupons when so provided by ordinance author- izing the bond issue, All such bonds shall specify for4hat purpose they are issued, and provisions shall be made at the time of issuance to pay interest and create a sinking fund sufficient to pay the princi- pal at maturity. Neither the money for which such bonds may be sold norf' the money raised to pay the interest and sinking fund thereof shall be diverted to any other purpose, and the City Treasurer shall not honor any draft drawn on said interest and sinking fund except to pay the interest on said bonds or to redeem the same except as hereinafter providedo 7 Whenever the accumulated sinking fund upon any issue of bonds shall amount to as much as one thousand dollarsP the same shall be applied at once to the discharge of a like amount of said bonds, and should the city not be entitled to redeem any of such series, and the holder be unwilling to surrender the same, said fund shall be invested in other validt interest-paying bonds of the City Of Wichita Falls, or of the United States or of the State of Texas, or any legally issued bonds of any I county, city or School district in Texas, as the Board of Aldermen may deter- mine, and'when so invested the bonds -Durchased and the interest thereon shall be held as a trust for the Particular fund from which the money was takenand shall not be sold or otherwise used except for the purpose of retiring the original bonds for the use of which the fund was created* All laws and parts of laws now in force, for the issuance of bonds upon the credit of the city and refunding of the bonds of the city, and the payment of the sane by taxation, are hereby continued in full force and effect, where not inconsistent here- ip,Tith.I And that upon the adoption of the aforesaid Amended Section 75, the present Section 75 shall be repealed and Amended Section 75 substi- tuted in -Lieu thereof*" SECTION 2* Said anendments shall be submitted at a special election; which said election shall be held on Tuesday, the 9th day of February, 1937, Said election shall be held at the regular polling places in each of the election precincts in said City, to-wit: CitAr voting PTec3*,nct 140- Qsntral-'P6li66"8tatj-an 4t i4at �`.'Inje, dlerk iFarris Llerk q#4#SNKd ',�ity voting Precinct iro, 1 is herein described as follows: SECTION 111.
