AN ORDINANCE PROHIBITING THE SALE OF BEER WITHIN THE ZONE IN THh CITY OF 'NICHITA FALLS PRESCRIBED IN THIS OADINANCE., AND FURTHER PROVIDING THAT NO LICENSE OR PEF?MIT BE ISSUED FOR THE SALE OF SAIE., EITHER BY THE STATE., COUNTY OR UITY., AND PROVIDING A PENALTY. BE IT ORDAINED BY THE BOARD OF ALDEMEN OF THE CITY OF WICHITA FALLSy TEXAS: SECTION 1. That no beer shall hereafter be sold and no license or per- mit shall be issued for the sale of same, either by the State of Texas, County of Wichita or City of Richita Falls within the following defined zone within the City of Wichita Falls., Texas, to-wit: Beginning at the intersection of Highway No. 5., and Jalonic Street; Thence 'dest on Jalonic to Mill Street; Southwest with Mill Street to dibley Avenue; Thence West on Sibley Avenue to Burnett Street; Thence South on Burnett to Underwood Street; Thence East on Underwood Street to County Farm Road; Thence South on County Farm Road to Holliday Greek; Thence with the meanderings of said creek to Highway 5; and Thence up the South side of Highway 5 to the place of beginning. SECTION 11. That any person who shall hereafter sell beer within the above set forth and described zone within the City of Wichita Falls. Texas, shall be guilty of an offense, and upon conviction in a court of competent jurisdiction shall receive such punishment as is provided by the dtatutes of the State of Texas., in the event it is held that such penalties shallapply to the violation of this ordinance. In the event that it shall be held and determined that the penalties provided in the Texas Liquor Control Act., Acts of 1935., 44th Legislature., 6econd Call Session, as amended by the Acts of 1937., 45th Legislature, do not apply to violations of this ordinance, then any person convicted in a court of competent jurisdiction of violating this Ordinance shall be fined in any sum not less than Twenty-five ($25.00) Dollars., nor more than Two Hundred ($2-00.00) Dollars. Section III. Should any paragraph, sentence or clause of this Ordin- ance be held unconstitutional or void for any reason., then the obher provisions hereof shall remain in full force and effect.
