AN ORDINANCE FIXING FARES TO BE CHARGED FOR TRANSPORTING
PASEENGERS WITHIN THE CITY OF WICHITA FALLS,, TEXAS., BY PERSONS,
TRUSTEES, FIRMS, ASSOCIATIONS AND CORPORATIONS ENGAGED IN THE
BUSINESS OF TRANSPORTING PASSENGERS FOR HIRE ON AND OVER DESIG-
NATED ROTJTES WITHIN SAID CITY AND ITS SUBURBS AND TO USE THE
STREETS, ALLEYS AND PUBLIC WAYS OF THE CITY FOR SUCH YURPOSE,
PRESCRIBING A PENALTY, AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
WICHITA FALLS, TEXAS:
SECTION 1.
Each and every person, trustee, firm, association and corp-
oration engaged in the business of transporting passengers for
hire over designated routes in the City of Wichita Falls, Texas,
and its suburbs is hereby authorized to charge not more than a
cash fare of ten cents per adult person for transporting or car-
rying such passenger on its motor buses , provided that four
tickets or tokens shall be sold for twenty-five cents to all
adult passengers who shall apply for same, and such tickets or
tokens shall be kept for sale by all motormen, bus drivers and
conductors on said buses ; and such other places in the City of
Wichita Falls as may be designated by such persons , trustees,
firms., associations and corporations .
The rates of fares provided for herein are for one contin-
uous ride in one direction over the bus lines of such persons,
trustees, firms , associations and corporations within the corp-
orate limits of the City and its suburbs. Round trip passage
over any line or lines for a single fare or the carrying of any
passenger by transfer from any point on bus lines to another
point in the same vicinity for a single fare shall not be re-
quired. Such persons, trustees, firms, associations and corp-
orations may, subject to the approval of the Board of Aldermen,
make such reasonable regulations not inconsistent herewith or
with other Ordinances relating to such matters as may be neces-
sary to prevent the misuse and abuse of transfers. Transfers
shall be given under provisions now fixed or hereafter fixed
by general Ordinance.
Children five years of age or less., when attended by a
passenger above said age, shall be carried free. Children be-
tween the ages of 5 and 12 years shall be carried for one-half
of the fare regularly collected for the transportation of adults.
Tickets in lots of twenty each, good for one trip over such bus
lines. shall be sold for one-half the regular fare collected for
the transportation of adults to students in actual attendance
upon any academic, public or private schools situated within or
adjacent to the City of Wichita Falls, Texas. All such passengers
shall enjoy the same rights for the use of transfers as are ac-
corded to passengers paying full fare.
All such persons , trustees, firms, associations and corp-
orations shall also Eive transfers to its passengers, which shall
be good for points within the City of Wichita Fails, Texas, or
its suburbs which are not reached by its buses and bus lines,
but which points are reached by other buses and bus lines being
operated within the corporate limits of the City of Wichita Falls,
Texas; and such company shall agree upon a pro rata division of
the fares charged, so that each bus company shall receive Its
fair share of such fares . If such agreement can not be reached
by the bus companies, then the matter shall be submitted to the
Mayor and Board of Aldermen of the City of Wichita Falls, who
shall prescribe a proper division of such fares, so that same
shall be fair and equitable to such operators of buses in the
corporate limits and suburbs of the City of Wichita Falls, Texas.
SECTION 2.
Every person, trustee, firm, association or corp-
oration doing a bus business in the City of Wichita Falls and
its suburbs, who shall violate this Ordinance, shall upon con-
viction in the corporation court of the City of Wichita Falls,
Texas, be fined any sum not less than $50.00, nor more than
$200.00.
SECTION 3.
If any part of this Ordinance shall be held to be
void or unenforceable for any reason, then the other parts here-
of shall remain in full force and effect.
SECTION 4.
The fact that Kell Field has been recently annexed
to and has become a part of the City of Wichita Falls, Texas,
and that the street and highway connecting Kell Field and Shep-
pard Field with the City of Wichita Falls is now within the corp-
orate limits of said city and the Wichita Transit Corporation is
now operating under a franchise and carrying passengers to Shep-
pard Field and to Kell Field at rates prescribed by its franchise
and for the rates prescribed by this Ordinance; and the further
fact that R.C. Bowen as Trustee for the Estates of A.C. Bowen
and Doris Bowen Frost using the trade name of The Twin Field Trans-
portation Company is also carrying passengers within the City of
Wichita Falls to Kell Field and Sheppard Field in competition with
Wichita Transit Corporation without a franchise from the City of
Wichita Falls and without any regulation of rates to be charged
by them for so transporting passengers within the City of Wichita
Falls, Texas, and its suburbs, creates an emergency,, and the rule
requiring the reading of Ordinances on three several days is here-
by suspended and this Ordinance shall take effect from and after
its passage and approval.
