AN ORDINANCE ALOPT"INIG THE PROVISIONS Oi� THE ACTS Or 1927, 40TH LEGISLATURE, PAGE 424, CHAPTER 283, '-vVHICE IS ALSO KNO'WN AS ARTICLES 101la-1011j, INCLUSIVE, OF' VERNONIS TEXAS CIVIL STATUTES ANNOTATED, AND CREATING A CITY PLANNING AND ZONING COMMISSION FOR THE CITY OF WICHITA FALLS, TEXAS, AND DESCRIBING ITS POWERS AND DUTIES. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. That the Acts of 1927, 40th Legislature, page 424 Chapter 283, also known as Articles 101la-1011j, Vernon' s' Texas Civil Statutes, be and the same are hereby adopted by the City of Wichita Fails as a basis and as a guide and to furnish rules and regulations for the zoning of said City; said Act to be supplemental and in addition to such zoning authority as is now granted said city by the Consti- tution of the State of Texas and its Charter and other laws of the State of Texas. SECTION 2 That there is hereby created and established for the City of Wichita Falls, Texas, a planning and zoning Commission which shall be composed of nine (9) membersJ six ( 6) of whom shall be representative, insofar as Possible, of different businesses, Professions or occupations, shall be resident citi- zens who pay taxes on real property within the city and quali- fied voters of the cit I who reside in different sections of the city, and three ( 3T of whom shall be ex-officio members, namely, the City Manager, City Engineer and one member of the Board of Aldermen, all of whom shall be appointed by the Mayor subject to confirmation by the Board of Aldermen, to serve for terms of six ( 6) years, except that the respective terms of five ( 5) of the six ( 6) members first appointed shall be one two, three, four and five years; and that the terms of ex-of-' ficio members shall correspond to their respective official tenures. All vacancies shall be filled for the unexpired terms in the same manner as Provided for the original appointments, and shall be for the terms as Provided for the original appoint- ments. Members of the Commission may be removed by the Mayor with the consent of the Board Of Aldermen, after public hearing and for cause assigned in writing. The members of the Commis- sion shall serve without compensation. No member other than an ex-officio member shall hold any other office Or Position with the city, except that one of them may also be a member of a Board of Zoning Appeals or Adjustments. SECTION 3. That the Planning and Zoning commission shall elect a Chairman, Vice-Chairman and a Secretary from its mem- bership and shall have power to employ such qualified persons as may be approved by the Board of Aldermen that are necessary for the proper conduct and undertaking of the Commission, which person.sshall be paid for their services and such other necessary expenses by voucher issued by the City Manager and City Clerk in the same manner that other city expenses are paid; Provided such payment shall not exceed the amount appropriated by the Board of Aldermen for the use of the Commission. SECTION 4. That the Commission shall also have power to make rules, regulations and by-laws for its own goverment, all of which rules, regulations and by-laws shall be approved by the Board of Aldermen and shall include among other items and provisions: ( a) Regular and special meetings open to the public; (b) Records of its proceedings to be open for inspection by the public; ( c) Reporting to the governin6 body and the public from time to time and annually; and (d) For the holding of public hearings on its recommenda- tion, provided that said Commission shall at all times give notice of the time and place for such public hearings by publi- cation in a newspaper of general circulation in the City of Wichita Falls at least fifteen ( 15) days before the time of such hearing. SECTION 5. That the Planning and Zoning Commission shall have the power and it shall be its duty to make and recommend for adop- tion a master plan for the City of Wichita Falls, Texas, as a whole or in parts for the future development and redevelopment of the city and its environnow0s and it shall be its duty to prepare a comprehensive plan and Ordinance with maps for zoning the city, in accordance with provisions of the Constitution of the State of Texas and applicable Statutes, Ordinances and Charter provisions. The Commission shall perform such other duties as may be prescribed by Ordinances of the City of Wichita Falls, or the laws of the State of Texas. PASSED AND APPROVED this day of A.D. 1943. laYOR.
