SECTION 1. That section 12-3016 of the codification of Ordinances

of the City Of 11�iclnlita Falls Texas., passed and approved January 6, 1941,
perscribed milk which does nopt confonu with any one Of the grades described
in this chapter shall not be sold in the City of Wichi'ta Falls.$ Texas, be
and the same is hereby amended so as to hereafter read as fol'iows, to-wit:
SBCTION 12-3016 That it shall hereafter be unlawful for any milk and/or
milk products to be sold to the final consum-er or to resturants., soda fountains
grocery stores Or Simi-liar establiskun
I ents except certified pasturized and Grade
A pasturized milk and/or milk uroducts as defined in the rules and regulations
promulgated by the State health- officer pursuant to Senate Bill nwiiber 83,
passed by the 45th Legislature, regular session Of 1937. Provided that -when
any milk distributor fails to qualify for one of the above grades the health
officer of the City Of Wichita Falls$ Texas, or the Director of the "�,ichita
Health Unit, "ilchita Falls 'i
Texas, is authorized to revoke his or its permit
or in lieu thereof to deglrade his product and permit its sale during a temp-
orary period
., not to exceed 30 days or in emergencies for such loAger period
as it may dee_� necessary. Provided further that all ordinances, or parts of
ordinances,, in conflict herewith are hereby repealed and this ordinance shall
be in full force and effect sixty days after its adoption and pu-blication as
provided bylaw.
