BE IT ORDAINED BY THE BOARD OF' ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. The transfer by VVichita Transit Corporation of the franchise granted to it by Ordinance No. 1337, passed and approv- ed on the 20th day of April, 1942, and accepted by said corpora- ticn April 251 1942, to Lone Star Coaches, Inc. , a Tennessee corp- oration, with a permit to do business in the State of Texas, is hereby approved; subject to the said Lone Star Coaches, Inc. tak- ing over and operating the buses and bus lines now operated by Vvichita Transit Corporation under said franchise, and• buses and bus lines now operated by Twin F'ieldsTransportation Company, or is successors, to Sheppard Field and Kell Field; upon schedules ,::moo be approved by the .Board of Aldermen and in compliance with the terms and provisions of said franchise and for such charges '=and fares as are now fixed or shall hereafter be fixed by Ordi- nance. SECTION 2. Said franchise shall be transferred subject to all its terms and conditions and it is understood that the said Lone Star Coaches, Inc. shall maintain an office in The City of Wichita Falls, Texas; that all buses operated by it under such franchise shall have their situs for taxation purposes in the corporate limits of The City of Wichita Falls, Texas; and that the Lone Star Coaches, Inc. shall pay or cause to be paid to The City of 'Wichita Falls, Texas, street rentals of two per cent of the gross income from the operation of buses to and from Sheppard Field and Kell Field by Twin FieldsTransportation Company and its successors beginning December 7, 1942. SECTION 3. The fact that it is desirable that all buses with- in the corporate limits of The City of 'dilichita Falls be operated under the same supervision and that a controversy heretofore exist- ing between The City and Twin Fields Transportation Company and its successors has been compromised and settled and that said set- tlement be put into effect as soon as possible creates an emergency, and the rule requiring the reading of Ordinances on three several days is hereby suspended, and this Ordinance shall take effect from and after its passage and approval. Fairtraee; I have re%r'_tten the Ordinance ap- provine, the transfer of the franchise of vVichita Transit Corporation to Lone Star Coaches, Inc . It occurred to me after re- writing it the first time that I had omitted one very important matter, and that was the payment of the two per cent street rental 4w u'Lti which wqs owing; by Twin Fields 'Transportation Company beginnint December 7, 1942. I men- tioned the matter to Mr. James and told him that we would probably put it in the Ordinance . Ne intimated that this would be all right and stated teat he would be willing to deposit such street rentals for the period from Dee- ember 7, 1942, to the date of the payment of the last street rental and turn it over to i ; ou when the Ordinance was passed. � f If you think that this provision should be in the Ordinance itself', you may substitute the Ordinance I am inclosin( for the other Ordinance.
