Any person violating this ordinance may be enjoined in a suit riled by the City of Wichita Falls, or other proper auth- ority, in a court of proper jurisdiction. SECTIOil 3. Any person, firm or corporation violating this Ordi- nance shall be guilty of a misdemeanor and upon conviction in a court of competent jurisdiction, shall be punished, as provided by The Texas Liquor Control Act; in the event it should be held that such penalty does not apply to this Ordinance; then such person, firm or corporation shall be fined not less than One Hundred Dollars ( $100. 00) , nor more than Two Hundred (Q200.00) Dollars, and each and every day of such violation shall constitute a separate offense. SH:CTION 4. That this Ordinance shall not apply to viholesale dealers, who shall sell at wholesale to retail dealers only and to no .other person, firm or corporation. SECTIOiy 5. If' any section, clause, paragraph or provision of this Ordinance shall be held unconstitutional or void, then the invalidity of such section, clause, phrase or provision shall not affect the other provisions of this Ordinance, and same shall remain in full force and effect. SECTION 6. The fact that the sale of intoxicating liquors has been recently authorized and legalized within the corporate limits of the City of Wichita Falls, Texas, and that the establish- ment of places of business outside of the district defined in this Ordinance would jeopardize the peace and health of citizens with- in the residence districts of said city creates an emergency, and this Ordinance is hereby declared an emergency measure on the ground -2- of urgent public need for the preservation of peace, health and safety of property; and the rule requiring the reading of Ordi- nances on three ( 3) several days is hereby suspended, and this Ordinance shall take effect from and after its passage and ap- proval, and after same has been published one time in the of- ficial newspaper of the City of -Wichita Falls, Texas. 1946.
