AN ORDINANCE GRANTING TO THE WICHITA VALLEY RAILWAY COMPANY,
ITS SUCCESSORS AND ASSIGNS, THE RIGHT TO CONSTRUCT, MAINTAIN AND
OPERATE AS A PART OF ITS SYSTEM A SPUR TRACK IN THE ALLEY BEW.]EEN
SCOTT AND LAMAR STREETS, AND BEGINNING AT THE SOUTH LINE OF 13TH STREET;
THENCE TO APPROXIMATELY 150 FEET NORTH OF 12TH STREET, EXTENDING
THROUGH BLOCK 209 aND 150 FEET INTO BLOCK 200, OF THE ORIGINAL TOIA.NSITE
OF WICHITA FALLS, TEXAS, FOR A PERIOD OF PTTTY—FIVE (25) YEARS.
BE IT ORDAINED BY THE BOARD OF ALDEFO- N OF THE CITY OF
WICHITA FALLS, TEXAS.
Section 1: That the right, privilege and franchise be,
and the same is, hereby granted to the Wichita Valley Railway
Company to construct, maintain and operate a spur track as a
part of its system in the alley between Scott and Lamar Streets in
the City of Wichita Falls, Texas, ana beginning at the South line
of 13th Street; thence along said alley approximately 150 feet
North of 12th Street, extending through Block 209 and 150 feet
into Block 200 of the original townsite of Wichita Falls, Texas.
Section 2: Said spur track shall be maintained by the
Wichita Valley Railway Company so that the lines shall conform with
the service of the alley upon which they lay,
Section 3: This franchise is granted subject to the charter
and the ordinance of the City of Wichita Falls, Texas, and all amend—
ments thereto.
Section 4: The Wichita Valley Railway Company shall conform
said spur track on said alley and any street crossings to any legally
order improved condition of any street or alley upon which said track
may lay.
Section 5: This franchise is granted for a period of 25
years from the date of its acceptance as hereinafter provided for
and shall be accepted by the slid Wichita Valley Railway Company
within 60 days from the date on which this franchise becomes ef—
fective under the charter and written acceptance hereof shall be
made by said Railway Coi-Lpany, and the same shall be filed with the
City Clerk of the City of Wichita Falls, Texas.
Section 6: This ordinance shall take effect and be in full
force and effect after its passage as provided in the City Charter
of the City of Wichita Falls , Texas.
