Gentlemen:
Reporting on Ordinance No. 1434, which is a franchise
granting a permit to the Wichita Valley Rail,,.ray Comrany to con-
struct and maintain a switch track_ in the alley between Indiana
and Scott Streets from Twelfth to Eleventh Streets.
In the proposed zoning ordinance as submitted by Hare
and Hare of Kansas City, City Plan Engineers, that portion of
the blocks between Eleventh and Fourteenth Streets and fronting
on Indiana has been zoned for light industrial plants. That
Portion of the same blocks fronting on Scott Street has been
zoned for retail business district. Therefore, this alley in
which it is proposed to extend the tracks is the dividing line
between light industry and retail shops and, of course, this is
al,,'ays a diffcult decision to make under the zoning regulations,
I personally see no serious objection to the construct-
ion of the switch track in this alley, provided that it be
required that concrete paving be constructed on this alley. I
do not think it advisable to construct the switch track in this
alley without paving because the grades are very flat and the
drainage, at the best, is very poor. Because of this fact the
,
construction of the track would practically block the al
vehicular traffic. ley to
Therefore, unless the alley is paved I would not issue
permit to construct the track.
