Ord 1441 9/25/1947 ORDINANCE N0. w� AN ORDINANCE PROVIDING FOR A C AND BUILDING BELONGING TO THE USTODIAN FOR THE 1-04ORIAL AUDITORIUM GROUNDS,CITY OF WICHITA FALLS, TEXAS, FIXING A SCHEDULE OF RENTS TO BE CHARGED FOR THE USE OF SUCH ADUITORIUM TO RENT THE AUDITORIUM AIdD/ OR GROUNDS AND COLLECT AND G ROU NDS$ ANCHARGES AUTHORIZING MAY IN SUCH CUSTODIAN AN EMERGENCY.N ORDINANCE;, HEREBY REPEALING ALL OTHER ORDINANCES IN CONFLICT HEREWITH AND DECLARING BE ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. That the City Manager of the City of Wichita Falls, Texas, is hereby designated and appointed as custodian of the Memorial Auditorium, grounds and buildin belonging to the City of Wichita Falls, Texas, g SECTION 2. That said custodian is hereby authorized to appoint and agents, servants and employees as in his judgment may be necessary to aid ormassistuhim in carrying out his duties as such custodian. SECTION 3. That the custodian is hereby authorized, and it is made his special duty to advise and manage such Memorial Auditorium, building and grounds, and he is hereby given complete authority and shall be responsible for the renting of the auditorium in said building and/ or grounds surrounding the i same, and collect therefor according to the following schedule: ng the rent 1. Grand Opera $150.00 2. Road Show Road Show - Matinee 150,00 3. Concerts 50.00 Local 50.00 each Road 100.00 each 4. Home Talent 50.00 5. Cooking School 50.00 6. Religious & Fraternal Lectures 7. Public School 40.00 each g. Religious Revival - Offering is taken per day 100.00 each day 9. Rehersals- Public School All Others No Charge 30.00 10. Matinees (All others) Half price regular 11. Political speakings 40.00 12. Auditorium Lawn all purposes 40.00 The Auditorium to furnish the following services, if and when , necessary, Heat, lights, and janitor service. For any use not mentioned herein, the custodian the rates shall be fixed by of said Memorial Auditorium and grounds, SECTION 4. All the rental contracts for said auditorium and/or be made through the custodian's office and a public record thereofshallo edkeptall in a book provided in said office, which record shall show the name of the lessee, the date of the execution of such lease, the use for which the auditorium and/or grounds are to be used and the date or day of such use. The persons renting or leasing said auditorium shall be re-quired to deposit with the custodian 50% (per aentum) of the schedule charge, and all persons leasing; the auditorium grounds all of the schedule charge at the time said property is leased for the time either is to be used for any particular date or day, and the balance of such rental shall be paid before the auditorium is used. In the event such lease contract is cancelled by the lessee, the portion of the rental charge paid upon the execution of said lease shall be forfeited to the City as liquidated damages. SECTION 5. That all funds collected by the custodian as rental on the City Auditorium and/or grounds, shall be deposited with the City Clerk,who shall place the same in the general fund of the City of 'Wichita Falls, Texas. SECTION 6. Ordinance No. 939, 989, 1073 and 1233, and all other ordinances con- flicting herewith are hereby repealed. The fact that the present rates being charged for the use of the Memorial Auditorium are excessive and it is necessary that such rates be inunediately reduced and the further fact that there is no ordinance fixing a rate of rental charge for the use of the auditorium grounds surrounding said Memorial Auditorium, creates and emergency; and the rules requiring the reading of the ordinances on three several days is hereby suspended and this ordinance shall take of ect imam diately upon its passage and approval. 7 PASSED AND APPROVED, this the�y day of A.
