AN ORDINANCE AILU DING SECTION TNO OF ORDINANCE NUBBER 1.451, PASSED
AND APPROVED ON THE EIGHTH DAY OF DECEMBER, A.D., 1947, CLOSING STREETS
AND ALLEYS AND RESERVING RIGHT OF WAY EASEYMTS FCR DRAINAGE PURPOSES AND
FOR PAINTENANCE AND OPERATION OF PUBLIC UTILITIES.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDER EX OF THE CITY
OF VaCHITA FALLS, TEXAS.
Section 1. That Section 2 of the Ordinance No. 1451, passed and
approved the 8th day of December, A.D., 19472 be and the same is hereby
amended so as to hereafter read as follows, to-wit:
That the closing of the streets and alleys described in Ordinance
No. 1451, shall be subject to a right of way easement for a drainage ditch
from the old water plant and settling basin as now located, with the right
of ingress and egress, for the maintenance and operation of the same and
there is hereby specifically reserved in said streets and alleys, described
in Ordinance No. 1451., a right of way easement for the maintenance of all
utilities now in said streets and alleys and all public utilities that may
hereafter be placed in said streets and alleys and the right to place public
utilities in said streets and alleys is hereby granted and the right of
ingress and egress is hereby reserved for the use of the owners and opera-
tors of all public utilities placed in said streets and alleys, for the
purpose of maintaining and operating the same for the benefit of the public
and the closing of said streets and alleys shall be further subject to the
provision that if any building or buildings are now constructed over any
existing sewer lines that the City of Wichita Falls shall not be liable to
the owners thereof for any damages resulting from the operation and mainte-
nance of said dewers or the operation and maintenance of said drainage
ditch, said owners to provide for adequate drainage across the property at
existing culverts, across the highway adjacent to the above described
property.
Section 2. The fact that a number of citizens and manufacturing
industrial corporations engaged in the oil business in Wichita Falls are
urgently in need of electric p6wer which cannot be furnished until the ef-
fective date of this ordinance, creates an emergency and it is hereby de-
clared that this ordinance is an emergency measure on the ground of urgent
public need and the rule requiring the reading of ordinances on three seper-
ate days is hereby suspended and this ordinance shall go into effect immed-
iately upon its passage and approval.
