VJ!ahEAS, on the 5th day of February, A. D. 19482 the Board of Aldermen of the City of Wichita Falls, Texas, passed and approved Ordinance No. 1452 regulating the location and use of buildings, structures, and land for trade, industry, residences, and other purposes, dividing said City in Districts and establishing by reference to a map the boundaries of said districts , and pro- viding for amendment of said ordinance under proceedings des- cribed in said ordinance and the laws of the State of Texas ; and, idIEREAS, after reference to the City Planning and Zoning Commission, as provided by said ordinance and law, said Commission has reported, requesting and recommending the redistricting and changes in said ordinance and map hereinafter ordained, and public hearings have been held, at which all owners of the property affected were given ample opportunity, after public notice by advertisement as required by said ordinance and the State Law, to file protests and criticisms, if any there be ; and, 6'vritL11LAS, it has been found that such changes would not be detrimental to the health, safety, morals, or general welfare of the community, and after giving reasonable consideration to the character of the districts , the peculiar suitability for the particular uses thereof, conservation of the value of said build- ings and property, and the most appropriate use of land in the city, it has been determined that such redistricting is proper and desirable : TH LRi;FORE, BE IT ORDAIN D BY TIE BOARD OF ALD jfflMN OF THE CITY Or., tiV'ICr1ITA FALLS, SECTION 1: That Ordinance No. 1452, passed and approved by the Board of Aldermen of the City of Wichita Falls on the 5th day of February, toathereinDbel948$ be changed,aanddamendednasg District follows : Map" referred (a) That all of the property fronting East in the 900 Block and lying on the for a depth of 150 feet, and being tsf Broad 9th and 10th Streets ) , described as follows, to-wit : All of lots B and C, and the East l00 feet of Lot A, of the Anderson and Bean Subdivision, and the Last 100 feet of Lot 11 Block 248 of Original Townsite, in Wichita Falls, Wichita County, Texas, be, and are hereby, changed from "District C" or "Apartment House District" , to "District D" or "Local Business District" . St;CTIOIV 2 : The City Secretary of the City of ',�Jichita Falls , Texas, is hereby ordered and directed to change and amend said "Zoning District iv'ap" so as to conform to the terms of this amendment and the changes and redistricting contained herein only, otherwise said Ordinance No. 1452 to remain in full force and effect. SEC`i'IOd 5 : The publication of public notice by advertise- ment of all notices of hearings of this ordinance, as required by the Charter or Ordinances of the City of Wichita Falls , or the Laws of the State of Texas, and all publications and advertisements of the pasOdances and aorroval StateoLaw,1are Ordinance required herebyauthorized,,�7 Ordinances said Charter, ratified, confirmed, and approved. SECTION 6 : The fact that this Ordinance regulates the kind and character of building and the locations thereof, and the further fact that delay in passing said ordinance may jeopardize the rights of property owners within the city, creates an emergency and this ordinance is hereby declared an emergency measure on the grounds of urgent public need for the preservation of tproperty rights, peace, health and safety of the citizenship, andrule requiring the reading of ordinances on three several days is hereby suspended and this ordinance shall take effect from and after its passage and approval.
