ti'VHEREAS, on the 5th day of February, A.D. 1948, the Board
of Aldermen of the City of Wichita Falls, Texas, passed and
approved Ordinance No. 1452, regulating the location and use
of buildings, structures, and land for trade, industry,
residences, and other purposes , dividing said City in Districts
and establishing by reference to a map the boundries of said
districts, and providing for amendment of said ordinance under
proceedings described in said ordinance and the laws of' the
State of 'Texas ; and,
WHEREAS, after reference to the City Planning and Zoning
Commission, as provided by said ordinance and law, said Commission
has reported, requesting and recommending the redistricting and
changes in said ordinance and map hereinafter ordained, and
public hearings have been held, at which all owners of the
property affected were given ample opportunity, after public
notice by advertisement as required bT said ordinance and the
State Law, to file protests and criticisms, if any there bp;
and,
WHEREAS,-''it has been found that such changes would not be
detrimental to the health, safety, morals, or general welfare of
the community, and after giving reasonable consideration to the
character of the districts, the peculiar suitability for the
particular uses thereof, conservation of the value of said
buildings and property, and the most appropriate use of land
in the city, it has been determined that such redistricting is
proper and desirable :

SECTION 1; That Ordinance No. 1452, passed and approved by
the Board of Aldermen of the City of Wichita Falls , on the 5th
day of February, A.D. 1943, to be amended, and the ttZoning
District 1Jap" , ref erred to therein be changed, and ameiided as
follows :
( a ) That all of the property fronting East in the 900 Block
and lying on the West side of Broad Street, ()between 9th and
loth Streets ) , for a depth of 150 feet, and being described as
follows, to-wit :
All of lots B,C, and D, and the East 150 feet of Lot
A, Anderson &. Bean Subdivision, and the East 150 feet of Lot
No. 1, Block 248 of Original Townsite, in Wichita Falls, Wichita
County, Texas,
be, and are herebv,changed from "District C" or "apartment
House District" , to "District D" or !°Local Business District" .
ShCTI01A 2 : The City Secretary of the City of Wichita Falls ,
Texas, is hereby ordered and directed to change and amend said
"Zoninrr District T,iap" so as to conform to the terms of this
amendment and the changes and redistricting contained herein
only, otherwise said Ordinance No. 14c2 to remain in full force
and effect.
SECTION 3 : In case any section, sentence or paragraph or
part of this ordinance shall for any reason be adjudged by
any court of competent jurisdiction to be invalid, such
invalidity shall not affect, impair or invalidate the
remainder of this ordinance.
SECTIOi 4 : Such parts of said Ordinance No. 14520 and the
"Zoning District Map" referred to therein and made a part there-
of, insofar as the same conflict with the provision of this
Ordinance, and all of Ordinance No. 1464, are hereby repealed.
S-C1'.10.L,4 5 : The publication of public notice by advertisement
of all notices of hearings of this ordinance, as required by the
Charter or Ordinances of the City of Wichita Falls, or the Lai is
Of the State of Te1Las , and all publications and advertisements
of the passing and approval of this irdinance required by said
Charter, Ordinances or State Law, are hereb;,r authorized, ratified,
confirmed, and approved.
Si-MIOI� 6 : The fact that this Ordinance regulates the kind
and character of building and locations thereof, and the further
fact that delay in passing said ordinance may jeopardize the
rights of property owners within the city, creates an emergency
and this ordinance is hereby; declared an emergency measure on
the grounds of ur-,ent public need for the preservation of
property rights, peace, health and safety of the citizensiiip,
and the rule requiring the readins; of ordinances on three
several days is hereby suspended and_ this ordinance shall take
effect from and after its passa=;e and approval.
