AN ORDINANCE CLOSING AND ADAhDONING TO USE BY THE PUBLIC,
EXCEPT FOR UTILITY EASEMENTS., THE ALLEY LYING BETWEEN THE SOUTH SIDE �
OF LOT,a 3, 42 .AND 5 AND THE NORTH SIDE OF LOTS 6, 7, AND 8, IN CX
NORTH. MORIIINGSIDE PARK .ADDITION. TO THE CITY OF WICHITA FALLS,: TEXAS, `C+:
AND. DECLARING AN EMERGENCY,
YvHEREAS, an application has been filed with the Board of
Aldermen of the City of Wichita Falls requesting the City Council
to cancel the dedication of an alley running East and YJest, lying
between the South side of lots 3, 4, and 5 and the North side of
lots 6, 7, . and 8, in North Morningside Park Addition to the City
of Wichita Falls, `and;
WHEREAS, a petition has been signed by all of the owners
of the land adjoining said alley requesting that the same be
closed, and whereas , it appears that said alley has never been
used by the public as an alley, arid, in most instances , has been
used by the respective property owners as part of their yards,
and has no city services of any nature located thereon:
BE IT ORDAINED BY TIJEE BOARD OF ALDLEMEN OF THE CITY OF
WICHITA FALLS
SECTION 1 : That the alley running East and West, lying
between the South side of lots 3, 4, and 5 and the North side
of lots 6, 7, and 8, North Morningside Park Addition to the
City of Wichita Falls , Texas , and more particularly described
as follows :
Beginnings at the Southeast corner of lot 3;
Thence in a Westerly direction along; the South
line of lots 3, 4 , aixd 5 to the Southwest corner of
lot 5;
Thence South 15 feet to the Northwest corner of block
6;
Thence in an Easterly direction along; the North lines
of lots 6, 7, and 8 to the Northeast corner of Lot 8 ; `
i Thence North 15 feet to the place of beginning ; as des-
cribed by the plat and dedication of the North hlorningside
Park Addition to the City of tiVichita Falls , Texas , as
shown in the plat and . deed records of Wichita County.,
Texas ;
be , and is hereby closed and abandoned for public use ; provided'"', �`
however, that the City specifically reserves its easement for `°
all public utilities .

SECTION 2 : The fact that the closinf; of said alley has "^
never boon officially proclaimed, and tho further fact that the
lack of said official closing is constituting; a cloud on the
title to said property, and the adjoining property, creates
an emergency, and the rule requiring; the reading; of ordinances
on three separate days is hereby suspE,,nded, and this ordinance
shall take effect immediately upon its passage and approval.
