wH,T;REr,S, by an instrument, dated October 28th, 1882, recorded
in Book E at pages 264 and 265 of the Deed Records of '�•�'ichita County,
Texas, R. E. Iontgomery2 as Trustee, appropriated and dedicated a strip
of land 25x3OO feet through Block No. 174 of the original City of
'V,ichita Falls, Texas, to be used as a public alley.
',,dE�,'REAS said dedicated 25 foot strip extends through said Block
No. 174 of the original City of Wichita Falls, Texas, from 8th to 9th
Streets in said City of Wichita Falls, `Texas.
V4`H1EREAS, the said Southwestern Bell Telephone Company, a corporat-
ion, is now the owner of all of Lot No. 7 in Block No. 174 of the original
City of Wichita falls, Texas, as shown by the recorded plat thereof, and
is also the owner of the East 50 feet of Lots Nos. g and 9 in block No.
174 of the original City of Wichita Falls,, Texas„ said East 50 feet of
said Lots S and 9 in Block No. 174 of the original City of Wichita Falls,
Texas, being directly 'wrest and just across the 25 foot alley from said
Lot No. 7 in Block No. 174 of the original City of Wichita Falls, Texas.
t;`1HEREAS it is deemed necessary by the Southwestern Bell Telephone
Company in order to furnish the City of y�ichita galls, Texas, telephone
service to erect a new building on the East 50 feet of Lots Nos. 8 and 9
in Mock NO, 174 of the original City of 14ichita Falls, Texas, and to
make other improvements on said building now situated on Lot No. 7 in
Block No. 174 of the original City of � ichita galls, Texas, aril it is
also necessary for said Southwestern Bell Telephone Company to connect the
building to be erected on the last 50 feet of Lots Nos, g and 9 in. Block
1o. 174 of the original City of 4 ichita Falls, 'texas, to the building
now erected on Lot No. 7 in Mock 11o. 174 of the original City of ',iichita
'Talls, Texas, and being used and occupied by said Southwestern Bell
Telephone Company.
'YVUEREAS, it will be necessary to locate, operate and Maintain
under said dedicated 25 foot strip underground conduits, wires, pipes
and other equipment extended betti^peen the building now erected by said
;southwestern >ell `lelephon.e Company and to be erected by said Southwestern
:.ell Telephone Company on each side of said 25 foot dedicated alley.
NGJs ` I L;R-PORN, BE IT ORDAINED BY the I0�oard of 'Lidermen of the
City of ',yichita galls, Texas, that the southwestern Bell Telephone
Coranany, its successors and assigns, are hereby authorized and granted
the right to build over the 25 foot strip above mentioned to join and
connect the upper stories of the building; now erected or to be hereinafter
erected on said Lot No. 7 in Block Lyo. 174 of the original City of
'Wichita r'alls, Texas, and the Last 50 feet of Lots Nos. 8 and 9 in },lock
No. 174 of the original City of I ichita malls, Texas, and there shall be
a clearance over said dedicated strip of 31 feet above the surface thereof
and the connection between the upper stories of said buildings, and said
strip so connecting said buildings shall be 10 feet in width, with no
openings, and said Telephone Company is also granted the right to place
and extend over said dedicated alley and between the upper stories of
said buildings above uentioned, wires, conduits, pipes and other equipment
deemed necessary in the operation of a telephone building and the opera-
tion of telephone equipment and to locate, operate and maintain conduits, pipes and other equipment under slid strip on each side thereof as clay be
necessary.
