AN ORDINANCE CLOSING AND ABANDONING CERTAIN
PORTIONS OF THE STREETS AND ALLEYS OF THE CITY OF WICHITA
FALLS, IN THE AREA OF THE TEXAS ELECTRIC SERVICE COMPANY
POWER PLANT, AND BEING A PORTION OF MILL STREET BETWEEN
ITS INTERSECTION WITH SAN ANTONIO STREET AND CHESTER
AVENUE; THE PORTIO11 OF CHESTER AVENUE BETWEEN 1JILL STREET
AND A POINT WEST OF BURNETT STREET TO THE LINE OF THE
NEW STREET ESTA-5LISHED BY THIS ORDINANCE; THE ALLEY THROUGH
BLOCK 31 OF THE I. JALONIC ADDITION; A PORTION OF BURNETT
STRE ET AND BEING THAT PORTION BETWEEN CE7,,STER AVENUE AND
TWENTY-FIRST STREET, AS WELL AS A TRIANGULAR PORTION WEST
OF LOTS 11 and 12, BLOCK 32, I. JALONIC ADDITION TO THE
CITY OF WICHITA FALLS; A PORTION OF TWENTIETH STREET
BEGINNING AT THE INTERSECTION OF BURNETT STREET AT TWENTIETH
STREET AND EXTENDING WEST A DISTANCE OF OT1E' HUNDRED TWENTY-
FIVE TWEET; AND A PART OF THE ALLEY THROUGH BLOCK 2,SIBLEY
TAYLOR ADDITION, RESERVING TO THE CITY ALL NECESSARY EXIST-
ING EASEMENTS FOR UTILITIES, IF ANY ARE NOW IN SAID STREETS
OR ALLEYS, WITH ADEQUATE DRAINAGE, AND PROVIDING THAT THE
CITY SHALL UNDER NO CIRCUIMSTANCES BE LIABLE FOR DAMAGES
IN THE EVENT BUILDINGS ARE CONSTRUCTED OVER EXISTING SEWER
OR WATER LINES BY VIRTUE OF THE P,'IAINTENANCE AND OPERATION
OF SAID SEWER AND WATER LINES.
IN ADDITION TO OPEN UP AND ESTABLISH IN LIEU
OF SAID STREETS SO CLOSED AND ABANDONED THE FOLLOWING
STREETS:

BEGINNING at the SW Corner of Lot No. 6, and the
NW corner of Lot No. 11, Block No. 32 I.Jalonic Addition to
the City of Wichita Falls; THENCE S 4053'E along; the West
line of said Lot No. 11, 32.0 feet to the-NVu corner of a brick
building for corner; THENCE N 550 071 E across Lots No.11 and
13, Block 32; 272.72 feet to a pointinthe East line of said
Block 32; THENCE North along the East line of said Block 32,
38.87 feet to the SE corner of Lot 5, and the NE corner of

SECTION 2: That the closing of said streets and
alleys shall be subject to a right-of-way easement for all
utilities now located therein, and it is hereby reserved in
said str--ets and alleys by the City for such utilities now
located therein, such easements, with a right of ingress and
egress for the maintenance of same, subject to the further pro-
visions that if any building or structure is now located over
any existing sewer or water lines that the City of Wichita
Falls will not be liable for any damages resulting from the
operation and maintenance of suchsewer or water lines, and
subject to the further provision that the streets herein closed
are part of the Texas Electric Service Coimmny Power Plant
yard, and no additional utilities shall be placed or laid
therein in such abandoned portions of said streets,and if in
the future, it is necessary for company purposes to move any
existing utilities in the abandoned streets or alleys,these
existing utilities and lines shall be moved at the expense of
the Texas Electric Service Company, and relocated so as not tp
impair the present useful purposes thereof.
SECTION 3; In lieu of the streets so abandoned and
closed, said City hereby opens up and establishes streets for
the use of the public as follows:
BLOCK NO. 322 I.JALONIC ADDITION:
BEGINNING at the SW corner of Lot No. 6, and the
YN corner of Lot No. 11, Block No-32, I.Jalonic Addition to
the City of ffichita Falls; THENCE S 34°531E along the West
line of said Lot No. 11, 32.0 feet to the NW corner of a brick
building for corner; THENCE i1 550071E across Lots No. 11, and
13, Block 32; 272.72 feet to a point in the East line of said
Block 32; THENCE North along the East line of said Block 32,

Subject to the obligation of the Texas Electric
Service Company to place such streets so opened, as to drain-
age and use for the public, in as good condition as the streets
so abandoned.
The fact that such closed streets will become a
part of the Texas Electric Service Co-lpany Power Plant yard,
and an imperative necessity exists for the enlargement and
improvement of said plant and the use of such abandoned
streets for said utilities, and by the further fact that the
streets so opened and established will serve the
public
better capacity and be more convenient and usefultoin a
the
public than those abandoned, and that such closing of the streets
and opening D? the others in lieu thereof will be of a direct
benefit to the inhabitants of the City of Wichita Falls and
those living in that vicinity, and such facts creating an
emergency:
