SECTIOL 1: That Section 12-304' ( Section 304 of Chapter
3, Title 12, Sanitary Code) of the Codification of Ordinances
of the 6ity of �lichita Falls, Texas, passed and approved by the
Board of Aldermen of the City of Y4ichita Falls, Te1:as, on the
6th day of January, A. L. 1941, be, and is hereby, amended so
as to hereafter read as follows:
"Section 12-304 ( 1083) All
bottles, cans, packa-;es, and other containers enclosing; milk
or any milk product defined in this Ordinance shall be
plainly labeled or marked with: (1) the name of the contents
as given in the definitions in this Ordinance; (2) the grade
Of the contents, if said contents are graded under the pro-
visions of this Ordinance; (3) the word tpasteurized' if the
contents have been pasteurized; (4) the .,iord I rawl if the
contents are raw; (6) the name of the producer or distributor
and the name of the city it is located within; (6) the per-
centage of milk fat, if the container or package encloses
adjusted milk, tCoffee cream'or'cereal milks shall not be
used on any label on any milk bottle or other milk container
or package unless the butter fat content in such container
is at least 11'. I -To fractional words indicating or tending
to indicate the ratio of riiilk to cream shall be used on such
label."
SECTION 2: In case a.ay section, sentence or paragraph or
part of this ordinance shall for any reason be ad iudr;ed by any
court of competent jurisdiction to be invalid, such invalidity
shall not affect,irtlpair or invalidate the remainder of this ordinance.
SE'CTIOA` 3: All ordinances, or parts of ordinances, in con-
flict herewith are hereby repealed insofar as the same are in conflict
with the provisions of this ordinance only.
SuXTI0i 4: The fact that milk is being sold in the City of
'ulichita Falls under labels vi'_liich are, or might be, raisleading, to the
public, and that the present City Ordinances provides no standard
by which newly created adjusted milk can be deter lined thereby
creatin., a hazard and jeopardy to the health and general welfare
of the public in the -ity of 'wichita Falls, creates an emergency
and an imperative public necessity, and this ordinance is hereby
declared an emert-;ency measure on the ground of urgent public need
for the preservation of the health and welfare of the citizenship,
and the rule requirinn the reading of ordinances on three several
days is hereby suspended, and this ordinance shall take effect
upon its passage, approval, and publica010:0:1.
