ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AMENDING APPENDIX B OF THE ZONING
ORDINANCE AT SECTION 1060, ENFORCEMENT, LEGAL
PROCEDURE AND PENALTIES; FINDING AND DETERMINING THAT
THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS
OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the Planning and Zoning Commission has recommended amending
Section 1060 of the zoning ordinance by increasing the permitted fines; and
WHEREAS, the City Council concurs with the recommendations of the Planning
and Zoning Commission and finds that the amendments proposed are in the public
interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Appendix B of the Zoning Ordinance of the City of Wichita Falls,
Texas, is hereby amended at Section 1060, Enforcement, legal procedure and
penalties, to read as follows:
"1060. Enforcement, legal procedure and penalties.
It shall be the duty of the city manager, through the proper departments, to
enforce this ordinance.
Any person who violates, disobeys, omits, neglects or refuses to comply with or
who resists the enforcement of any of the provisions of this ordinance shall be guilty of
a misdemeanor offense, punishable by a fine as provided in Section 1 -14 of the Wichita
Falls Code of Ordinances. The imposition of one penalty for any violation shall not
excuse the violation nor permit it to continue, and each day that the violation is
maintained shall constitute a separate offense. The application of such penalty shall not
be held to prevent the enforced removal of prohibited conditions."
SECTION 2. It is the intention of the City Council of the City of Wichita Falls,
Texas, that the provisions of this ordinance shall become a part of the Code of
Ordinances of the City of Wichita Falls, Texas, and that sections of this ordinance may
be renumbered or relettered to accomplish such intention.
SECTION 3. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
