ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, WAIVING SECTIONS 82 -62 AND 82 -63 OF THE CODE
TO PERMIT SALES AND POSTING OF SIGNS AND RESERVATION OF
A PORTION OF THE LUCY PARK TRAIL FOR A FUNDRAISING EVENT
BY THE PLACE ON DECEMBER 12 AND 13, 2003; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, The Place wishes to host a fundraising event in Lucy Park on a
portion of the public trail on December 12 and 13, 2003; and
WHEREAS, in order for the event to be more successful, they request
permission to conduct sales, post signs, and to reserve a portion of the trail; and
WHEREAS, The Place has indicated they will not require vehicles on the grass
or additional electricity for the set up and operation of the proposed booths and activity
areas.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Sections 82 -62 and 82 -63 of the Code of Ordinances are hereby
waived to permit sales and posting of signs during a fundraising event by The Place in
Lucy Park on December 12 and 13, 2003. This waiver shall apply only to the area of the
park reserved for The Place's exclusive use during this fundraising event, identified in
the map attached as Exhibit A and incorporated herein. It is understood this approval is
an experiment and is being granted because it is during colder weather when the public
trails are less used.
SECTION 2. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
