RESOLUTION TO APPROVE CHANGE ORDER #2 AND ACCEPT THE
FM 2380 UTILITY RELOCATION PROJECT AND AUTHORIZE FINAL
PAYMENT TO JALYN CONSTRUCTION, INC.; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls entered a unit price contract with Jalyn
Construction, Inc. with the estimated total cost of $168,065.00; and
WHEREAS, previously the Council has approved a Change Order in the amount
of $22,170.00, increasing the estimated contract price to $190,235.00; and
WHEREAS, the Contractor encountered unknown conditions that required the
relocation of the water line due to a telephone duct bank and a concrete cap over the
Lake Arrowhead raw water line which incurred additional costs for pavement repair and
lost time in the amount of $9,340.00; and
WHEREAS, approval of Change Order No. 1 will increase the estimated contract
price to $199,575.00; and
WHEREAS, the actual work was completed at a total cost of $190,912.50 of
which $177,941.05 has been previously paid to the contractor leaving an amount due of
$12,971.45; and
WHEREAS, the City Staff has inspected the work and found it to be acceptable.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Change Order #2 for the FM 2380 Relocation Project in the amount
of $9,340.00 is approved and the FM 2380 Utility Relocation Project is hereby accepted
and the City Manager is authorized to make final payment to the contractor.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
