RESOLUTION TO APPROVE CHANGE ORDER NO. 3 AND ACCEPT
THE 1999 BUDGET UTILITY IMPROVEMENT PROJECT AND
AUTHORIZE FINAL PAYMENT TO S &G CONSTRUCTION COMPANY,
INC.; FINDING AND DETERMINING THAT THE MEETING AT WHICH
THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls entered a unit price contract with S &G
Construction Company, Inc. with the estimated total cost of $584,832; and
WHEREAS, two Change Orders No. 1 and No. 2 have been previously approved
increasing the contract with an estimated total cost of $599,084.32; and
WHEREAS, the Contractor encountered unknown conditions, the required
additional equipment for boring, lost time, and in addition was required to make
modifications to two lift stations in the amount of $23,200.00; and
WHEREAS, approval of Change Order No. 3 will increase the estimated contract
price to $622,284.32: and
WHEREAS, the actual work was completed at a total cost of $616,563.32 of
which $581,496.05 has been previously paid to the Contractor; and
WHEREAS, the Contractor incurred 128 days of liquidated damages for a total
amount of $30,720.00; and
WHEREAS, the amount due to the Contractor is $4,347.27; and
WHEREAS, the City Staff has inspected the work and found it to be acceptable.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Change Order No. 3 for the 1999 Budget Utility Improvement
Project is approved and the 1999 Budget Utility Improvement Project is hereby
accepted and the City Manager is authorized to make final to the Contractor.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
