RESOLUTION TO APPROVE CHANGE ORDER NO. 3 AND ACCEPT
THE RECOATING OF THE NINTH STREET ELEVATED WATER
STORAGE TANK AND DIGESTER NO. 2 AT THE RIVER ROAD
WASTEWATER TREATMENT PLANT PROJECT AND AUTHORIZE
FINAL PAYMENT TO ELEVATED TANK APPLICATORS, INC.; FINDING
AND DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls entered into a unit price contract with
Elevated Tank Applicators, Inc. with the estimated total cost of $359,000.00; and
WHEREAS, previously Change Orders No. 1 and No. 2 have been approved in
the amount of $8,250.00 increasing the estimated contract price to $367,250.00; and
WHEREAS, the Contractor was required to clean old caulking from the lap joints
and replace the caulking with epoxy which incurred additional costs in the amount of
$13,248.00: and
WHEREAS, the City was required to perform repairs to certain facilities at the
cost of $457.92; and
WHEREAS, the final amount of Change Order No. 3 will be $12,790.08 will
increase the estimated contract amount to $380,040.08; and
WHEREAS, during the course of construction, the Contractor incurred 34 days of
liquidated damages at a rate of $240 per day for a total of $8,160.00; and
WHEREAS, the actual work was completed at a cost $385,935.08 of which
$345,265.00 has been previously paid to the Contractor leaving an amount due, after
deducting liquidated damages of $32,510.08; and
WHEREAS, the City Staff has inspected the work and found it to be acceptable.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Change Order No. 3 for the Recoating of the Ninth Street Elevated
Water Storage Tank and Digester No. 2 at River Road Wastewater Treatment Plant in
the amount of $12,790.08 is approved and the Recoating of the Ninth Street Elevated
Water Storage Tank and Digester No. 2 at the River Road Wastewater Treatment Plant
is hereby accepted and the City Manager is authorized to make final payment to the
Contractor.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
