RESOLUTION GRANTING TWO UTILITY EASEMENTS TO
MIDWESTERN STATE UNIVERSITY ACROSS CITY -OWNED
PROPERTY TO ACCOMMODATE THE STUDENT HOUSING
EXPANSION PROJECT; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN
TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, Midwestern State University has the approval to begin construction
of the student housing expansion project; and
WHEREAS, plans for this project require two (2) storm sewer utility easements to
be granted to Midwestern State University across Midwestern Parkway and the Taft
Boulevard right -of -way and the City aqueduct, and
WHEREAS, it is fully understood and agreed upon that any problems that may
arise or any damages that may occur regarding these easements granted to
Midwestern State University that any and all such problems and /or damages shall be
remedied at the sole expense of Midwestern State University, and
WHEREAS, it is additionally understood that if for any reason in the future the
City of Wichita Falls needs these storm sewer easements re- routed and or removed
from the City's aqueduct, it will be done solely at the expense of Midwestern State
University, and
WHEREAS, the City Council of the City of Wichita Falls, Texas deems it
advisable and in the public interest to grant the storm sewer easements as requested to
Midwestern State University.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The City of Wichita Falls shall grant the following easements
located in Wichita Falls, Wichita County, Texas to Midwestern State University for the
student housing expansion project in consideration of the receipt of $5,524.00:

Field notes of a 20.0 foot wide easement across the Taft Boulevard Right -of -Way
and the City aqueduct, the centerline of which is described as follows:
BEGINNING at a point in the West line of Taft Boulevard which bears S 000 23'
40" E a distance of 167.45 feet from its intersection with the South line of Midwestern
Parkway; THENCE S 070 59' 26" E a distance of 82.67 feet to an angle pint; THENCE
S 010 03' 07" W a distance of 114.31 feet to an angle point; THENCE S 070 27' 18" E,
at 27.77 feet crossing into the City aqueduct and continuing on the same course, in all a
distance of 81.71 feet to its intersection with the South line of said aqueduct and the
North line of a 2.69 acre tract conveyed to Midwestern State University.

Field notes of a 20.0 foot wide easement across Midwestern Parkway, the
centerline of which is described as follows:
BEGINNING at a point in the South line of Midwestern Parkway which bears N
890 42' 00" W a distance of 1491.0 feet from its intersection with the West line of Taft
Boulevard; THENCE N 000 00' 17" W a distance of 85.0 feet to the North line of
Midwestern Parkway and
BEGINNING again in the South line of Midwestern Parkway at a point which
bears N 890 42' 00" W a distance of 1605.2 feet from its intersection with the West line
of Taft Boulevard; THENCE N 780 36'43" W a distance of 58.0 feet to an existing storm
sewer manhole.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
