RESOLUTION APPROVING THE SALE OF APPROXIMATELY
99.6 SQUARE FOOT OF EXCESS RIGHT -OF -WAY LOCTED AT
1212 BROAD STREET AND AUTHORIZING THE EXECUTION OF
A QUITCLAIM DEED TO CONVEY TITLE; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls owns 99.6 square foot of right -of -way
located at 1212 Broad Street; and
WHEREAS, it has been determined that the Trade Winds Hotel is
encroaching on this right -of -way; and
WHEREAS, the sale of this property produces no injurious effect to the
City of Wichita Falls.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. As authorized by Chapter 272 of the Texas Local
Government Code, the City of Wichita Falls shall sell the following described
excess property located in Wichita Falls, Wichita County, Texas:
FIELD NOTES OF A 99.6 SQUARE FOOT TRACT OF LAND OUT OF
THE BROAD STREET RIGHT -OF -WAY AS SHOWN ON THE PLAT OF THE
T.H. COLLINS SUBDIVISION OF THE EAST HALF OF BLOCK 251 OF THE
ORIGINAL TOWNSITE OF WICHITA FALLS AS RECORDED IN VOLUME 4,
PAGE 26 OF THE PLAT RECORDS OF WICHITA COUNTY, SAID TRACT
BEING DESCRIBED BY METES AND BOUNDS ON THE ATTACHED EXHIBIT
"A ". Said right -of -way is to be sold to the Trade Winds Motor Hotel for $1,000.00
SECTION 2. The City Manager is hereby authorized to execute the
quitclaim deed on behalf of the City of Wichita Falls.
SECTION 3. It is hereby officially found and determined that the meeting
at which this resolution was passed was open to the public as required by law.

In the city of Wichita Falls, WICHITA COUNTY, on US HIGHWAY 287, the State of Texas
(state) used certain land for highway purposes, there being no record title thereto in the state's name.
The land, described in Exhibit A, is no longer needed as a part of the state highway system.
IT IS THEREFORE ORDERED by the Texas Transportation Commission that the
designation of the land as part of the state highway system is hereby canceled and that jurisdiction of
the land is transferred to the City of Wichita Falls. The executive director or his designee is directed
to notify city officials of this action.

SAID TRACT BEING DESCRIBED BY METES AND BOUNDS AS
FOLLOWS:
BEGINNING at a point in the East line of said Block 251 which bears S 350 00' E a
distance of 68.05 feet from its Northeast comer;
THENCE S 35° 00' E with the East line of said Block 251 and the West right -of -way line
of Broad Street a distance of 181.08 feet to a point for the Southwest corner of this tract;
THENCE N 55° 00' E a distance of 0.60 feet to a point for the Southeast corner of this
tract;
THENCE N 35' 06W a distance of 181.08 feet to a point for the Northeast comer of this
tract.
THENCE S 55° 00' W a distance of 0.50 feet to the PLACE OF BEGINNING and
containing 99.6 square feet of land.
