RESOLUTION NO.
RESOLUTION PLACING A MORATORIUM ON THE APPLICATION OR
PERMIT PROCESS RELATED TO THE CONSTRUCTION, INSTALLATION OR
PLACEMENT OF COMMUNICATION TOWERS; FINDING AND DETERMINING
THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS
OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, The Planning and Zoning Commission is considering and
deliberating regulations related to the height of towers and structures; and
WHEREAS, It is the desire of the Planning and Zoning Commission and the City
Council to protect public health and safety; and
WHEREAS, The economic future of Sheppard Air Force Base /Municipal Airport
and Kickapoo Airpark directly impact the general welfare of the City, which is directly
related to the proper placement of towers; and
WHEREAS, The City Council has determined that this moratorium is necessary
to secure the purposes herein.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. During this declared moratorium period, as established hereby, no
permits for the construction, installation or placement of a communications tower shall
be issued nor shall any application for a permit be accepted.
SECTION 2. For the purpose of this moratorium, a tower shall be a structure
intended for wireless communications over 50 feet tall as measured from ground level,
or as measured 50 feet below the surfaces and zones defined under Section 6400 of
Appendix C, Code of Ordinances or as defined under 36 FAR Part 77 for Kickapoo
Airpark for a general aviation airport with non - precision instrument approach or a non -
precision instrument runway. This moratorium shall also be in effect for a structure
added to the top of a building intended for wireless communications
SECTION 3. This moratorium shall be in effect until such time that the City
Council adopts regulations related to communication towers.
SECTION 4. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
