RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS AUTHORIZING THE CITY MANAGER TO SELL THE
TWO LOTS FACING SEVENTH STREET AND ADJACENT TO THE
LITTLEST SKYSCRAPER FOR THE ENHANCED DEVELOPMENT OF
THE LITTLEST SKYSCRAPER; FINDING AND DETERMINING THAT
THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS
OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the law allows the sale of irregular shaped and /or undersized
parcels to be sold to adjoining property owners at fair market value and without public
notification; and
WHEREAS, the following properties have been appraised by a certified,
independent appraiser and the fair market value of the properties has been determined
as follows: 507 7th Street ($1,250.00), 509 7th Street ($1,665.00) and 511 7th Street
($833.00); and
WHEREAS, all adjacent property owners, with the exception of the Heritage
Society, have stated in writing that they are not interested in acquiring the property; and
WHEREAS, the Heritage Society has made the request to purchase the
properties located at 507 and 509 Seventh Street which they wish to sell along with the
Littlest Skyscraper to enhance a development project, and
WHEREAS, a private developer will agree to spend a substantial amount of
money to bring the property up to a standard ready for rental, and
WHEREAS, it is the desire of the City Council that the sale of this property in
conjunction with the Littlest Skyscraper will facilitate the long term preservation and
utilization of the property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The City Manger is hereby authorized to execute the necessary
legal documents to transfer title to the Wichita County Heritage Society the property
located at 507 Seventh, legally described as 25x100 ft of Lots 1 and 2, Block 162,
Original Townsite, and 509 Seventh, legally described as 162'3 ft of West 50 ft of Lot 1
and West 50 ft of Lot 2, Block 162, Original Townsite (see Attachment A). Before
executing any title transfers authorized by this Resolution, the City Manager shall first
determine the proposed documents of sale of the property by the Wichita County
Heritage Society shall provide adequate provisions to insure the long -term preservation
and utilization of the improvements on the property.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
