RESOLUTION EXERCISING THE CITY OF WICHITA FALLS' RIGHT OF
FIRST REFUSAL FOR ACQUIRING A 0.073 ACRE TRACT OF RIGHT -
OF -WAY AT THE INTERSECTION OF BROAD AND CENTRAL
FREEWAY (US 281 -287) AND DECLARING NO INTEREST IN SAID
PROPERTY; FINDING AND DETERMINING THAT THE MEETING AT
WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE
PUBLIC AS REQUIRED BY LAW.
WHEREAS, the Texas Department of Transportation is owner of a 0.073 -acre
tract right -of -way at the intersection of Broad and Central Freeway and has determined
that is no longer needed; and
WHEREAS, abutting property owners have requested the right to purchase said
right -of -way from the State; and
WHEREAS, all affected utility companies and all affected City departments have
been contacted and studied the need for said right -of -way and have determined that no
need exists; and
WHEREAS, the City Council of the City of Wichita Falls, Texas deems it
advisable and in the public interest to declare no interest in the purchase of this right -of-
way.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. There is no need for the 0.073 -acre right -of -way as shown on the
attached plat and further described as follows:
FIELD NOTES OF A TRACT OF LAND BEING MORE COMMONLY KNOWN AS
PART OF LOTS 11 & 12, BLOCK 8, SIBLEY TAYLOR ADDITION, AN
ADDITION TO THE CITY OF WICHITA FALLS, TEXAS, AS RECORDED IN
VOLUME 2, PAGE 132, WICHITA COUNTY PLAT RECORDS, WICHITA
COUNTY, TEXAS, AD BEING MORE SPECIFICALLY DESCRIBED BY METES
BOUNDS AS FOLLOWS:
BEGINNING at a Y2 inch iron rod in the East right -of -way line of Broad Street, a
dedicated street, for the Southwest corner of said Lot 12 and the Southwest
corner and place of beginning of this tract:
THENCE North 00 °47'35" East 75.96 feet along said East right -of -way line to a
'/2 inch iron rod for a point of curvature for the Northwest corner of this tract:
THENCE in an Easterly direction along a 705.613 degree curve to the right,
having a radius or 8.12 feet and a central angle of 139 057'16 ", an arc distance of
19.83 feet to a point of tangency in the Southwest right -of -way line of Central
Freeway for the Northeast corner of this tract, the long chord bears North
77 013'20" East a distance of 15.25 feet:
THENCE South 31 012'30" East 93.79 feet along said Southwest right -of -way line
to a Y2 inch iron rod in the South line of said Lot 12 for the Southeast corner of
this tract;
THENCE North 89 012'25" West 64.53 feet along said South line of Lot 12 to the
place of beginning and containing 0.073 acres, more or less.
SECTION 2. The City Council of the City of Wichita Falls, Texas concurs in the
State's plan to sell this right -of -way in accordance with the established laws and
regulations of the State of Texas.
SECTION 3. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
