RESOLUTION WAIVING A MORATORIUM REGARDING THE
CONSTRUCTION OF A COMMUNICATIONS TOWER AT 2914 OLD
JACKSBORO HIGHWAY AS REQUESTED BY SBA INC. OF AUSTIN,
TEXAS; FINDING AND DETERMINING THAT THE MEETING AT WHICH
THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the City Council, by Resolution No. 4 -2001, placed a moratorium on
the construction, installation or placement of communication towers for a six month
period or until such time that regulations regarding this use were adopted; and
WHEREAS, the intent of the moratorium was to allow sufficient time to develop
regulations to protect public health, safety and general welfare regarding airspace
navigation and proximity of towers to other land uses; and
WHEREAS, SBA Inc. of Austin, Texas has requested that the moratorium be
lifted to allow the construction of a communications tower; and
WHEREAS, the City Council has found that lifting the moratorium will be in the
public interest.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Resolution No. 4 -2001 is hereby declared not to apply to the
location at 2914 Old Jacksboro Highway and that any preceding regulations shall only
be utilized in granting approval for the proposed communication tower.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
