The City Council of the City of Wichita Falls, Texas met in regular session on the above
date in the Council Chambers of the Memorial Auditorium Building at 8:30 o'clock a.m., with the
following members present:

Mayor called the meeting to order.
Item 2
Pastor Scott VanBidder, First Church of the Nazarene, gave the invocation.
Item 3
Mayor proclaimed December 6, 2004 as "Matt Malone Day in Wichita Falls" in recognition of
Matt becoming an Eagle Scout. Matt Malone accepted the proclamation and expressed
appreciation to those who supported him and encouraged him throughout this effort. He
encouraged others to do the same. Matt's mother and sisters were in attendance.

City Manager gave a briefing on the items listed under the Consent Agenda,
Councilor Elmore requested that Item 6a be brought down to the Regular Agenda.

Item 6a
Moved by Councilor Ammons to receive the minutes of the Wichita Falls Park Board,
September 23, 2004 meeting.
Motion seconded by Councilor Williams.
Councilor Elmore asked for clarification on Item D of the Park Board Minutes where it
indicates that the McGrath Creek Project is dead.
City Manager mentioned that there was a plan to do a creek extension under Maplewood
that goes all the way to Kemp that included a walkway with a raised bridge and traffic underneath,
however, that was cost prohibitive. Mr. Jack Murphy concurred and stated that the Council did not
express an interest when it was brought before them.
Councilor Elmore asked if it was the McGrath Creek Drainage Project. Mr. Murphy replied
that it is the creek from Faith Village but it is McGrath Creek to Kemp Street and it overlaps with the
Faith Village Storm Water Drainage Project.
City Manager noted that the McGrath Creek Project was completed some time ago.
Clarification was made that no drainage project had been affected.

Item 7a
A proposed ordinance was presented considering an appeal of Conditional Use
Permit# C 04-34.
Moved by Councilor Williams that proposed ordinance be passed.

Mr. Dave Clark informed that the address should be 2203 Missile Road and not 2303
Missile Road.
Mr. Clark informed that notices had been sent to the property owners. The area of interest
was discussed at length in regards to the residential use, the traffic, and quality of life issues, as
well as other storage units in our City.
David Rhone, 4804 Pine Hurst, applicant, spoke in favor of this ordinance, noting previous
developments that they had built and the asset they had been to our City, and he wants to make
this vacant property into a productive piece of property.
Clyde Buckmore, 5403 Greentree, was representing the people who attended the Planning
& Zoning meeting where this issue was considered. He spoke against the ordinance, stating that it
would be in the middle of a residential and school zone area, and because of the topography it
would create visual problems, which would increase traffic hazards. He did not think that a storage
unit facility should be placed in the middle of an already developed and established residential
area.
Margaret Hawkins, 5502 Hooper, spoke against the ordinance, stating they would like to
maintain the area as residential. She was opposed to having a building with a chain link fence that
looked like a prison in residential areas.
The issue of the fence was discussed along with possible suggestions. Mr. Rhone
explained their fencing plans and reasons for the security fence. He stated that they are open to
recommendations for security. He also mentioned that the apartment complex they built had
storage units and they have not had any break-ins. He said they want to be good neighbors and
want this to be an asset to Expressway Village.
Moved by Councilor Williams to amend the proposed ordinance to reflect the address as
2203 Missile Road instead of 2303 Missile Road.
Motion seconded by Councilor Norrie and carried by the following vote.

Moved by Councilor Norrie to amend the proposed ordinance by deleting the brackets and
the word "denied" in Section 1, and by deleting the brackets and the word "deny" in the last
whereas.

City Council recessed at 10:25 a.m. and reconvened at 10:45 a.m.

City Clerk provided information on the election date including early voting dates and
location. City Clerk also gave a presentation on the ballot wording. City clerk informed that the
wording on the ballot would be exactly as required by the City Charter. City Clerk explained the
ballot propositions on the recall election, noting that a vote "For the recall of William K. Altman"
means that voter wants Mayor Altman removed from office, and a vote "Against the recall of
William K. Altman" means voter does not want Mayor Altman removed from office.

Item 9a
Councilor Ammons complimented the persons who were responsible for organizing the
Veteran's Day Parade. It was a great effort.
Councilor Norrie addressed the issue of the recall petition stating his feelings and concerns
about the issues before, during and following the recall petition. He agreed with Councilor Williams
that their tactics were political terrorism, forcing someone to do something they do not agree with.
He felt that the tactics used were union tactics and these types of things are done in New York, Ft.
Worth, and the larger cities, not in Wichita Falls. It is inappropriate and demeaning to our City.
The genesis of the recall was over changes made to the training of our police officers. A lot
of time and evaluation was looked into, changing it to be more effective and to put more officers on
the streets. If we do not have enough officers on the streets we have a problem. The training in the
past has been very appropriate but there are always different ways to approach, matters and
different ways of training. I have listened to VRJC on outsourcing and to the ex-chief and other
officers, and I have heard a lot of allegations, which he checked into and found out that there was
misinformation, half-truths, and out and out lies. Creditably is very important.
In my business, decisions have been made that I do not like but I have options and one
option is to leave. The City of Wichita Falls is analogous to a small corporation where the City
Manager is the CEO, and the Council is the board. The City Manager made a policy of how we
were going to train our officers and it was met with controversy and discussion. It was placed on
the Council agenda for our endorsement. I voted against it because I feel when a CEO (City
Manager) issues a mandate to his employees they are expected to follow it or they have the option
to leave. It was not done that way and I felt the Board (Council) did not need to endorse it so I voted
against it.
A handful of officers with the Police Department do not want to lose control of the training.
Nobody likes change or to lose control of certain situations. I am disappointed with the faction that
has come from this agreement. It has been very aggressive and there have been a lot of half-
truths, semi truths that have been propagated by this. Individuals of the Police Department are
excellent, however, my observation is that the union or these small groups that are behind this are
using tactics not seen in our City. These are hostile political terrorist tactics, political terrorism.
They make threats that disrupt city government, disrupt personal lives, and say as many bad things
as they can about people to make people afraid to vote and that angers me. There are many ways
to get good trained officers on the streets and we have a good resource of officers now. We have
laterals coming in and we will have their expertise. We have not had a full complement of officers
in a long time. Anyone thwarting putting additional officers on the street should not be tolerated.
Through the tactics of the Police Union, I am convinced that there is an effort to delay the
police candidates. On the same day the ex-chief resigned, there were a number of applications on
his desk of applicants that were ready to be put on the streets. After Chief Bachman was
appointed he put those officers on the street and I am told that by the end of November we might
have a full complement of officers on the streets in full shifts.

I fully support the training policy and I know there will be continual changes to make it right.
Captain Borrego is in charge of that and we have a lot of confidence in him and our new Chief. He
will get through it and do what is right for our City.
The recall petition is a union action that puts pressure on the City Council, delays City
business, causes unrest, intimidation, and gives the City a bad image. We fight very hard to keep a
good image in Wichita Falls. These types of antics have no place in the City of Wichita Falls.
A small faction is recalling the Mayor not because he is doing a bad job but because they
want to send a message to the City Council. They want to affect the City and put something in
place that we do not agree with. The easiest thing to do is to lay low and ride it out. They have
said that after Mayor Altman, we are next. Is that the type of city government the citizens want? I
can guarantee that they don't. They don't want that type of intimidation.
I think the ex-chief's resignation was planned and premeditated. They were waiting for the
right reason or any type of comment to go out. The comment the Mayor made was factual and it is
not a reason for someone to quit because of a statement like that.
The job the Mayor has done in Wichita Falls has been the best. He has been used as a
scapegoat and I am glad he is not resigning. It would show he is giving in to a threat and we would
be in a real mess if he did resign. If he resigned it would not change the way I think or the way I
would handle this. That does not send a message to me. This recall has made us stronger and
united six of us on the Council. We have become very resolute against these type of activities. It
does not scare or deter us.
I had called for an outside audit in the City Manager's office but I am going to wait until after
the Civil Service investigation and after the recall election because we have enough turmoil going
on right now. The recall has caused us to study the outsourcing training issue and I am convinced it
will work in some form or fashion. It validates the change the City Manager made. It is showing the
citizens how ridiculous this is. I am getting more comments that this does not make sense and how
disappointed they are with this. I am sorry for the Mayor and his family. It is not right that they have
to protect their father and grandfather.
I would plead with the individual officers to do what you think is right, not what an
association or a union pressures you to do. Do what is correct and right for the City of Wichita
Falls. We are blessed with a lot of good people. It is showing the citizens the City does not have to
deal with unions like other cities do and I hope the citizens are vocal about these types of tactics.
There are ways to air differences but at the end when there is a vote you have to abide by what is
mandated or we have the option to leave.
I have enjoyed knowing all the council members and I gravitated especially toward
Councilor Ammons. Obviously there has always been an inherited conflict of interest. We all have
conflicts of interest, but it is up to us to squelch them or abstain or not get on the Council if the
conflict of interest is paramount.
Councilor Ammons is Mr. Coughlin's mother-in-law and the grandmother of his children, and
has been an advocate to the Police Department. The fact that she has gone after the Mayor and
has not discussed with him privately or publicly some of her issues, I think really belittles her seat
as a city council person. I think it is okay to disagree with somebody, you can support a movement,
but to actively participate in a movement really demeans your seat and the constituents you
represent. It hurts me to say that but that is what I believe. I think you have demonstrated that
your relationship with the ex-chief is a conflict of interest that is out of control for you. Whatever
you do after this is your business but I felt very strongly about saying this.
Councilor Esther was glad that there are signs of cleaning up on Maurine Street,
Councilor Esther thanked Mr. Jack Murphy for the signs at the waterfalls. He asked that city
limit signs be placed at the entrances to the City of Wichita Falls.
Councilor Esther stated that it is through goodness and forgiveness that we have been
blessed. I have never carried any bitterness against anyone. Some people vent their frustrations
when they are suffering. Councilor Norrie has spoken what I felt in my heart regarding this situation
that we are facing. These people were given an opportunity to change their way when the first
petition failed but they did not take that opportunity. The Mayor is a unique individual and we must
learn to accept others' individuality. I hope and pray that those of you out there remember a
quotation we learned a long time ago. "Judge not lest you be judged." It is the peace we have
within our hearts that has made our community safe. That is the basis of Christianity. Bitterness
contributes only to anarchy.

Councilor Elmore asked Mr. Murphy to look into a "Welcome to Wichita Falls, the proud
home of SAFB" sign. I think we need to give as much recognition as we can to SAFB.
Councilor Elmore is aware that we are all concerned with what is going on but the rights of
citizens are to ban together and do what they are doing right now. Like Councilor Norrie I cannot
take them to task for their feelings and actions, which are perfectly legal. I do not agree with them.
I believe in the old adage that says, "I may disagree with you completely but I will defend to the
death your right to say it", because that is the American way.
Councilor Elmore announced that because of all the activities in December he will resume
the District 5 meetings in January.
Councilor Williams stated that she and Councilor Elmore agree on the right of citizens to do
whatever they feel they must do as long as it is done legally. I will always stand behind that when
citizens have those rights they should be religiously guarded.
I want to qualify some things. She mentioned that the Dallas Morning News states that the
council there is being taken to task for not getting along as a council. I hope we do not have that
problem on an ongoing basis. I hope that whatever happens that we can grow from it and I hope
we grow stronger, but it is done and now we have to deal with the actual election. I feel that
whatever happens on February 5 will be the will of the voters of the City of Wichita Falls.
I think the recall was ill conceived and ill advised but we need to go on with the election.
Many citizens who signed the petition say they knew nothing about the principles. I do not fault the
people, my problem is with the originators and that will not change, but it is done.
As a councilor, parent, and citizen of Wichita Falls I must stand up and be counted when it
comes to what I think is a wrong move against people who have done no wrong. I keep hearing
about certain principles in this matter who have created a hostile climate. So I am asking that
anyone who has proof that anyone in this City deliberately created a hostile environment to write a
letter to any council member or me. She provided the address and informed that staff does not
open their mail. We have to set up some sort of concept as to what has been created. As for Jim
Berzina and Jan Stricklin, if they have done something illegal, unethical or immoral let us know
about it so we can understand what you want to do. I do not plan to fire anyone that has not been
proven that they have done anything wrong. I do not see anything wrong with continuity of
employment. If we let this kind of stuff dictate on who we will ask who to fire then no one's job is
safe here. We have to find other ways to deal with people. If an employee has a situation let us
know about it. If we do not know what the problem is, the problem will still exist even if there is a
new mayor and a new council. We need to know the whole story, not portions. She suggested that
people not sign things to get rid of people they don't like next time just don't invite them to your
party. I plan to stand up for what is right and to stand up for people who need folks to stand up for
them, and that is what I plan to do.
Mayor informed that City emails are public record. He also informed that he had asked staff
to read his email because it keeps him from missing things on his calendar because he does not
read his email on a daily basis. He also noted that Councilor Elmore asked the staff to read his
email.
Mayor read an article that was sent to him entitled "Police, Power and Politics". The subject
is a speech written by Ron DeLord, CLEAT's President. He quoted a couple of paragraphs from
the article. "DeLord has spent the last 20 years building the largest police union in Texas and has
advised about what to do when a police organization is up against a city or state government. It is
impossible to beat a city but it is possible to beat the person who represents the city. Find the
person who is putting their foot down about the contract of whatever it is the union is fighting for
and target them instead of the City. Do anything you can within legal limits to bother them. DeLord
sighted examples of handing out fliers with the official's phone number printed on them with a
request to call them with the issue at hand, and generally getting in the person's face until he gives
in." Mayor quoted DeLord " It may not be nice but it is legal and it works."
Mayor asked Mr. Reuben Warren to report on the Grease Trap Ordinance and how it is
working. Mayor also asked Mr. Dave Clark to give an update report on the Holt Hotel.
Councilor Elmore confirmed that he staff opened his mail upon his request.

Mr. Clark informed that there was a scheduled Thoroughfare Plan public meeting on
November 30 at 7 p.m. at the Library in Room 204.
Mayor announced that this ends the televised segment.
Item 10
Elvin Dudley, 2518 Shepherds Glen, realtor and builder, asked Council to review Resolution
112-89 adopting sale of water service in the City, particularly the second paragraph, and that they
allow the sale of water to people wanting to start small businesses.
