Item 1
The City Council of the City of Wichita Falls, Texas met in regular session on the above
date in the Council Chambers of the Memorial Auditorium Building at 8:30 o'clock a.m., with the
following members present:

Mayor called the meeting to order.
Item 2
David Brock, 1819 Hines, complained about City employees issuing tickets for burning fire
in barrels, and he accused them of not knowing or caring about the law. He called it harassment
and said it was time that something was done about it. He said he should not have to sue the City
to stop this harassment.
Mayor Altman informed Mr. Brock that his previous concern dealing with his stolen car has
been investigated and he will correspond with him after he reads the investigation report. In
regards to Mr. Brock's current matters, the Mayor informed him that the City Council sets policy but
does not handle the administration. Any City employee concerns that Mr. Brock has are between
him and the City Manager.
Item 3
Pastor Larry Suttle, Church of Christ, gave the invocation.
Item 4
Mrs. Olivia Carrillo, Assistant City Registrar, Health Department, was recognized as
employee of the month for May 2003. Mayor presented Mrs. Carrillo with a plaque, City pin, check,
dinner for two, and golf passes.
Mayor proclaimed May 4-10, 2003 as "Respect for the Law Week" in Wichita Falls and he
encouraged all citizens to join with the Optimist Club members in carrying the message of respect
for the law in exercising responsible citizenship. Councilor Burns accepted the proclamation on
behalf of the Optimist Club and briefly explained this annual event where the Optimist Club
recognizes members of law enforcement. Three members of different law enforcement agencies
will be recognized today.

Item 5
Mayor Altman and City Clerk Lydia Torres canvassed the results of the City Election held
on May 3, 2003.

ORDINANCE NO. 42-2003
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS,
CANVASSING THE RETURNS OF THE MUNICIPAL GENERAL ELECTION HELD
IN THE CITY OF WICHITA FALLS, TEXAS ON MAY 3, 2003; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS
PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW
Moved by Mayor Altman that Ordinance No. 42-2003 be passed with the following results
inserted in the blanks.
597 voters voted
255 votes for Don Johnston
34 votes for Richard King III
305 votes for Linda R. Ammons
Linda R. Ammons was duly and legally elected Councilor District 1.

It was noted that Councilor At-Large Arthur Bea Williams and Councilor District 2 James

Item 7
City Clerk, Lydia Torres, administered the official oath of office to Arthur Bea Williams,
Councilor At-Large; Linda R. Ammons, Councilor District 1; and James Esther, Jr., Councilor
District 2.
City Council recessed at 8:55 a.m. for a reception welcoming the re-elected officials.

Mayor reconvened the City Council meeting at 9:25 a.m.

The Minutes of April 15, 2003 and April 18, 2003 were approved as distributed.
Items 10a-11 c
City Manager gave a briefing on the items listed under the Consent Agenda. He informed
that corrected copies of the April 23, 2003 Metropolitan Planning Organization minutes were placed
in Council boxes prior to this meeting.
Mayor asked that item 11 b be removed from the Regular Agenda.

Mayor explained that the April 23, 2003 minutes had not been approved by the MPO so
they would be draft minutes. He did not think that draft minutes should be accepted until approved
by the MPO. Once approved by the MPO they can then be placed on a future Council agenda for
acceptance.

Item 12d
A proposed ordinance was presented amending Chapter 26, Business Regulations at
Article VIII, Wrecker Businesses.
Moved by Councilor Ammons that proposed ordinance be passed.
Motion seconded by Councilor Burns.
Chief Coughlin explained the proposed fee deduction, the purpose of the impound yard and
the towing procedures.
Consent and non-consent towing was discussed. Council expressed concern that the intent
to regulate private property tows was not stipulated in the proposed ordinance. Mayor suggested
that this ordinance be tabled for clarification and further review by Staff.
Another concern expressed by Council was the requirement for outside City wreckers called
into the City by vehicle owners to tow their vehicles.
Moved by Councilor Williams to table the proposed ordinance for clarification.

CONDITIONAL USE PERMIT CASE NUMBER C 03-19, AND APPROVING THE
CONDITIONAL USE PERMIT WITH THE CONDITION THAT THE FRONT OF THE
MANUFACTURED HOME FACE HUNTINGTON LANE; FINDING AND

Joseph Betsinger, 4501 Huntington Lane, property owner, spoke in favor of this ordinance.
The following persons spoke against this ordinance.
Charlotte Spraggins, property owner adjoining Mr. Betsinger's property,
Lois Moore, 6307 FM 369, property owner adjoining Mr. Betsinger's property,
Terry Moore, 4523 Huntington, closest resident to Mr. Betsinger's property.
Roland Marchand, 209 Wyneth, owner of property near Mr. Betsinger's area, wanted to
know if manufactured homes were going to be allowed out there so he could determine what he
was going to place or require on his property.
City Attorney informed that the Council could not outlaw manufactured homes and they
could not refuse to permit them for just any circumstance.
Mayor explained that this was the first time an issue like this had come up since the
annexation. One of the reasons for annexation is for orderly development in an area. I agree with
the City Attorney that the issue is not whether to accept or not accept manufactured homes. There
are brick homes out there and the compatibility issue has some merit and it is criteria that can be
used.
V.C. Moore, 6307 N. FM 369, felt that a manufactured home next to a brick home would
bring the property value down.
Moved by Councilor Williams to accept option C requiring that the house face Huntington
Lane.

Mr. Harold Lerew, Perdue, Brandon, Fielder, Collins & Mott partner, responded to
questions, and provided collection percentages, and explained the process that is used.

Item 14a
Councilor Esther said he had received complaints about the increase in the appraised
property value. Councilor Hawkins informed that it is based on how much the other houses in the
area have been sold for.
Councilor Hawkins mentioned the rash of vandalizing in the cemeteries. He asked that the
parents talk to their children to respect these areas. He appealed to those who had vandalized to
make restitution.
Councilor Williams asked Staff to check the property at 1636 Wilson for tall grass and
weeds.
Councilor Williams mentioned the April 26 event where families of the deployed military
personnel were invited to the Disney on Ice show. It was a wonderful evening at the Kay Yeager

Coliseum and she thanked those who caused this to happen, especially the family members. She
gave Kudos to Councilor Hawkins and the Shriners for their help.
Councilor Ammons thanked the 600 voters who voted and especially the 305 who voted in
her favor.
Councilor Ammons also expressed appreciation for the Disney on Ice evening and thanked
those who helped.
Councilor Ammons mentioned that there were semi-trucks still parking in residential areas.
Councilor Williams reported that there were some parked downtown as well. Major Bachman
informed that citizens needed to call dispatch to report these violations and they will be taken care
of. He asked for the exact locations where the violations were taking place.
Councilor Burns informed on the Optimist's celebration of law enforcement officers this
week.
Councilor Burns congratulated his colleagues for their re-election. He stated that this job is
not as easy as it looks, and he is appreciative of the way the Council conducts themselves when
there are difference of opinions and the votes are other than unanimous.
Councilor Norrie also congratulated the re-elected Council members.
Mayor informed that the City had sponsored families of deployed soldiers to an evening
dinner and Disney on Ice. He thanked the sponsors who financed this without cost to the taxpayers
- Union Square Federal Credit Union, United Regional Health Care Center, Times Record News,
and Wichita Valley Scottish Rites Club who donated money unsolicited that allowed the purchase
of hats and other things for the children. He read one of several letters he had received from
attendees. He mentioned that it was a great evening and the delight and excitement in the young
children's eyes was a sight to behold.
Mayor commented that this morning Council had a very long discussion which while
tedious, in the issue that dealt with a plat of land in the annexed area, was a great example of
democracy in action. We may not always agree but one of the things we have been able to do in
our relationship with each other is to disagree in an agreeable manner. The degree of respect that
we treat each other with, over the last year and will continue for the next years, is rewarding to us
and to the citizens. We are serious about doing the business of the community and you are well
represented by theses folks particularly those that were just re-elected to office.
Councilor Burns mentioned that Janice Buss, Midwestern State University Marketing
Department, asked him to distribute t-shirts to advertise Midwestern State University. He has
distributed t-shirts to Council and Staff.
Councilor Norrie mentioned that Mayor Altman's wife, Doris, came up with the idea of
sponsoring the families of deployed soldiers, and she should also be thanked.
Councilor Williams stated that the Council desires to do what is best for the constituents but
the good thing is that when we leave here no one is sniping at anybody else and it is all taken care
of in here and we do not bear grudges toward each other. We were elected to do what we think is
proper and no one should have to be explaining it, justifying, and forever defending, and being
harassed and that is happening. That reflects what this Council ought to be doing and what this
Council does in particular.
Item 14b
Major Bachman reported on the speeders on Lake Park Drive. We set out the radar trailer
and then the motorcycle cops. He reported on the parking problem on Gregg Road around the
soccer fields noting that no tickets had been issued but they did receive four complaints. The
Soccer Association was contacted and asked to assist by notifying those who go out there about
the parking situation. The Police Department will stay on top of that.
Major Bachman reported on the citations issued in the Sunnyside area around Hines Street.
They will continue to monitor the area.

Item 14b continued
Councilor Williams thanked the Police Department for checking on the walking trail near
Weeks Park. She said she was very satisfied with what the Police Department is going to do out
there. They have very competently taken care of the safety of the walkers in that area.
Mr. Dave Clark informed that the final draft of the preservation documents have been
placed in Council boxes and he would appreciate any comments from Council.
City Manager informed on the ice situation at the Coliseum noting that the facility is not
damaged and that there are certain procedures that must be taken with the ice several times a
year. He informed that George Casper would make a final state of the Coliseum in June.
City Manager reminded Council and citizens that the next Council meeting will be May 20 at
6:00 p.m.
