RESOLUTION TO ESTABLISH A VALUE FOR SIDEWALK ESCROW IN
LIEU OF CONSTRUCTION; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN
TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City Council desires to establish a standard amount for
escrowing where it is not possible to construct sidewalks that are required under
Chapter 27 of the Municipal Ordinances; and
WHEREAS, where it is determined by the City Engineer that it is not possible to
construct sidewalks on a site, the below amount can be placed in escrow to guarantee
the construction, or to be held in perpetuity, until such sidewalks are installed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The value of $2.00 per square foot is established to determine the
cash deposit to be held in perpetuity by the City, if it is determined by the City Engineer
that it is not possible to construct sidewalks on a site as required in Chapter 27.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
