A RESOLUTION OF THE CITY OF WICHITA FALLS, TEXAS,
AUTHORIZING THE CITY MANAGER TO EXECUTE ON BEHALF OF
THE CITY OF WICHITA FALLS THE PURCHASER'S OATH SEEKING
APPROVAL OF THE ACQUISITION OF A PORTION OF THE WICHITA
VALLEY WATER SUPPLY CORPORATION DISTRIBUTION SYSTEM
AND SERVICES TO SIX CUSTOMERS IN THE FM 367 AREA; FINDING
AND DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls has recently annexed an area known as the
FM 367 area, which contains six water customers being served by the Wichita Valley
Water Supply Corporation; and,
WHEREAS, the City and the Wichita Valley Water Supply Corporation have
reached an agreement to sell this portion of the distribution system to the City of
Wichita Falls, and the City has agreed to provide water service to these individuals;
and,
WHEREAS, it is necessary for the Water Supply Corporation and the City to
seek approval of the sale and /or transfer of these customers to the City of Wichita Falls
by the Texas Natural Resource Conservation Commission.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. That all of the above recitals and preambles are found to be true
and correct and made a part hereof for all purposes.
SECTION 2. The City Manager is hereby authorized to execute on behalf of the
City of Wichita Falls the oath for the purchase and the application for the sale and /or
transfer of the above - mentioned customers to the City of Wichita Falls, the same to be
filed with the Texas Natural Resource Conservation Commission.
SECTION 3. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
