Res 029-2000 3/7/2000e RESOLUTION NO. Cf - RESOLUTION REPEALING RESOLUTIONS 120 -86 AND 32 -94 AND ADOPTING A REVISED LUCY PARK LOG CABIN RENTAL AGREEMENT. FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the Lucy Park Log Cabin continues to be a popular rental facility for the residents of Wichita Falls; and WHEREAS, time has revealed the need to make certain revisions in the regulations in order to improve the rental process. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Resolutions 120 -86 and 32 -94 are hereby repealed and the attached revised Lucy Park Log Cabin rental agreement is adopted. SECTION 2. It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. PASSED AND APPROVED this the 7th day of March 2000. The log cabin may be reserved up to six months in advance and is available for rent seven days a week from 6:00 a.m. until 11:00 p.m. The cabin may not be opened prior to the reserved rental time. It must be cleaned and vacated by the end of the rental time. Any other use, other than pre - rental inspection, is trespass of public property. 2. Renting the log cabin is arranged in person, at the Parks and Recreation office, located at 1300 Seventh (7th) Street in the Memorial Auditorium, room 109. Renter must be an adult and a resident of the City of Wichita Falls. Times are as follows: 1St rental time 6:00 a.m. -10:00 a.m. $40.00 2nd rental time 10:00 a.m. - 2:00 p.m. $40.00 3rd rental time 2:00 p.m. - 6:00 p.m. $40.00 4th rental time 6:00 p.m. -11:00 p.m. $50.00 3. Rental Fee and Deposits are prepaid. Deposits for cleaning ($100) and keys ($15) are paid along with the rental fee before the cabin is reserved. Cash, check, cashier's check, money order, Visa or MasterCard are accepted. Reservations made two weeks or less before the date shall be paid with cash or credit card or cashier's check. 4. A maximum of fifty -five (55) persons may be present within the cabin. 5. There are 5 tables (measuring 8'x 30" each) and 55 chairs stocked in the log cabin. The kitchen has a sink and large counter top work area, but, no refrigerator, stove, or dishwasher. 6. Youths (18 and under) must be chaperoned by a minimum of one adult per fifteen youths. 7. Keys shall be picked up at the Parks 8v Recreation Office. For weekday reservations pick up keys the day before. For Saturday and Sunday reservations pick up keys on Friday after 1:00p.m. If Renter fails to pick up keys before the office closes, the keys may be picked up after showing the rental receipt at the Police Department located at 610 Holliday at 7th Street (Telephone # 761 - 7611). A $30 portion of the Renter's damage /cleanup deposit shall be retained. Keys must be returned to the Parks and Recreation office the next workday following the event or the key deposit will be forfeited. 8. Sales will be permitted within the park or Log Cabin area with a contract signed by the Director of Parks and Recreation. PAGE 2 OF 10 PAGES AGENDA ITEM NO. 12.A 9. Consumption of alcoholic beverages is permitted within the Log Cabin with the written approval of the Director of Parks and Recreation. 10. Decorations may be affixed to any portion of the cabin by securing with string or tape only. No tacks or nails may be used. 11. Report immediately any problems with heating /cooling units, water heater, restroom malfunctions, etc., to this office. 761 -7491. After 5:00 p.m. and weekends, call the Police Department, 761 -7611. No attempt is to be made to repair any of the above items. 12. Clean-up requirements of Renter include: • Clean tables and chairs and re- stack. • Pick up all decorations, string, tape, paper goods, food, bottles, cans, and other debris and deposit in the trash barrel located in the parking lot. • Sweep and mop floors in an acceptable manner. A mop and broom are stored in the kitchen area. Cleaning products are stored in the lower kitchen cabinet. In the event all of a product is consumed, please report this information at the time the key is returned. • Leave the log cabin litter container empty and clean and replace plastic liner from supplies stored in the lower kitchen cabinet. 13. When leaving the log cabin Renter shall turn off lights and the air conditioner control, set heater thermostat to 50° in winter, and lock the windows, doors, and the fence gates before leaving the premises. 14. The Parks and Recreation Department staff or other designated City employee may inspect a function at any time evidence is received the property is being damaged or policies violated. If Renter is advised to cease such behavior and continues such, the Renter may be instructed to immediately vacate the Log Cabin. 15. The key and building deposits will be returned within ten working days after keys are returned and no damage or uncleanness is reported. Should damage or clean up exceed the deposit the Renter will be billed for the additional costs. Payment is due immediately upon receipt. 16. Refunds on cancellations are permitted only if the Renter notifies the Parks and Recreation Department office in writing, facsimile, or E-mail _two weeks or more prior to the rental date. A cancellation charge of $20 will be retained from the rental fee. The Renter will receive the balance of the rental fee and deposits by mail within ten working days of the notification. There is no refund of rental fee if notice is received within two weeks of rental date.
