RESOLUTION AUTHORIZING THE CITY MANAGER TO SUBMIT AN
UPDATE FORM TO THE PUBLIC UTILITY COMMISSION OF TEXAS
REQUESTING A CHANGE IN THE ALLOCATION RATIOS FOR
ACCESS LINE FEES PURSUANT TO HOUSE BILL 1777; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, House Bill 1777 changed the way in which municipalities in Texas
charge telecommunication providers for use of its right -of -way from a negotiated
franchise fee to a standard monthly access line fee; and
WHEREAS, the Public Utility Commission has established three access line
categories; and
WHEREAS, the Public Utility Commission has currently established that the City
of Wichita Falls' access line ratios for both Non - Residential Low Capacity lines and
Non - Residential High Capacity Lines will be 2.4 times the fee for a residential line; and
WHEREAS, the City of Wichita Falls wishes to change the ratio for Non -
Residential High Capacity Lines to 3.5 times the fee for a residential line.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The City Manager is hereby authorized to submit an update form to
the Public Utility Commission requesting that the ratio for Category 3, Non - Residential,
High Capacity Access Lines, be changed from 2.4 times the residential fee to 3.5 times
the residential fee.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
