Res 043-2000 4/4/2000RESOLUTION NO.47D —arn RESOLUTION AUTHORIZING THE ADOPTION OF A TEMPORARY RATE INCREASE FOR TAXICAB SERVICES DUE TO UNUSUAL GASOLINE PRICES; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the existing rates for taxicab fares went into effect on July 18, 1996 with the adoption of Ordinance No. 107 -96; and WHEREAS, the price of gasoline has increased significantly in the last several months; and WHEREAS, the City of Wichita Falls has received a request from the local taxicab companies to consider a temporary surcharge on trips to offset the increased cost of gasoline. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. A surcharge of fifty cents ($0.50) per trip is hereby allowed to be charged by taxicabs, in addition to the existing rates, as set forth in Ordinance No. 107 -96, subject to the following conditions. (a) The surcharge will be allowed immediately upon passage of this resolution for a period of six months and shall expire at midnight on October 3, 2000; and (b) If the price per gallon of low -lead gasoline that the City of Wichita Falls pays (BASE PRICE) is equal to or less than ninety -four cents ($0.94) per gallon for thirty (30) consecutive days, the City shall notify each holder of a current taxicab franchise, via certified mail to the address on file with the City Clerk, that the surcharge authority is suspended. Each holder shall have no more than five (5) days from the date of the notice to withdraw the surcharge, or by the expiration date set forth in paragraph (a) whichever occurs first; and (c) If the surcharge authority is suspended per paragraph (b), it shall be reinstated if the BASE PRICE exceeds ninety -four cents ($0.94) per gallon for thirty (30) consecutive days. The City shall notify each holder of a current taxicab franchise, via certified mail to the address on file with the City Clerk, that the surcharge authority is reinstated subject to the above conditions; and (d) The surcharge will be posted in the taxicab in accordance with the provisions of Chapter 31, Section 31 -60, Display of Rate Card, of the Code of Ordinances. A -- SECTION 2. It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law.
