The City Council of the City of Wichita Falls, Texas met in special session on the above
date in the Council Room of the Memorial Auditorium Building at 4:00 o'clock p.m., with the
following members present:
Jerry Lueck - Mayor
Arthur Bea Williams - Councilors
James Esther, Jr. -
Bill Altman -
Johnny Burns -
Harold Hawkins -
James Berzina - City Manager
Bill Sullivan - Assistant City Attorney
Ramona Coln - Deputy City Clerk
Dan Shine - Absent
Mayor Lueck called the meeting to order.
Councilor Hawkins gave the invocation.
Item 3a
ORDINANCE NO. 30-2001
ORDINANCE MAKING AN APPROPRIATION FROM GENERAL FUND EQUITY FOR PURPOSES
OF ACCEPTING THE PROPOSALS FOR THE CONSTRUCTION OF THE MPEC COLISEUM
PROJECT; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW
Moved by Councilor Altman that Ordinance No. 30-2001 be passed.
Motion seconded by Councilor Williams.
City Manager presented a report on the Coliseum Funding Plan, a copy of which is attached
hereto as Exhibit A. He explained that the $165,783 appropriation is strictly to provide coverage for
the contract amount. That money would be reserved for this purpose only and no actual money
would be moved or spent from this reserve. This appropriation would allow the project to proceed.
Councilor Williams stressed that the general fund money would never be spent, but was
only being reserved until the rest of the private donations are honored. As the donations come in,
the amount received will be reduced from the reserved amount and returned to the general fund.
Motion carried by the following vote.
Ayes: Mayor Lueck, Councilors Williams, Esther, Altman, Burns, and Hawkins
Nays: None
Item 3b
A proposed ordinance was presented making an appropriation from General
Fund Equity to Account No. 100-8710-72170 in an undetermined amount, utilized for the
settlement of pending litigation styled No. CCL-905-96-F; Sherry Ann Norman and Freddie
Ray Norman v. City of Wichita Falls.

Motion seconded by Councilor Burns and carried by the following vote.

RESOLUTION NO. 27-2001
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WI HITA C FALLS
TEXAS, ACCEPTING THE PROPOSALS FOR THE CONSTRUCTION OF THE
MPEC COLISEUM PROJECT; AS RECOMMENDED BY THE MPEC BOARD, IN
THE AMOUNT OF $19,683,198; AUTHORIZING THE CITY MANAGER TO SIGN
ALL APPROPRIATE CONTRACTS FOR THE CONSTRUCTION OF THE MPEC
COLISEUM; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY
LAW
Moved by Councilor Williams that Resolution No. 27-2001 be passed.
Motion seconded by Councilor Esther and carried by the following vote.
Ayes: Mayor Lueck, Councilors Williams, Esther, Altman, Burns, and Hawkins
Nays: None

City Council went into Executive Session at 4:24 p.m. as authorized by Section 551.071 of
the Texas Government Code.
City Council reconvened at 4:43 p.m.
No action was taken.
City Council adjourned at 4:49 p.m.
