Res 089-2000 7/5/2000RESOLUTION NO. 9,q - RESOLUTION APPROVING AN AMENDMENT TO THE FY 1999 -2000 BUDGET FOR THE WICHITA FALLS (413) SALES TAX CORPORATION IN THE AMOUNT OF $300,000 FOR MATCHING FUNDS FOR THE SIKES LAKE DREDGING PROJECT AS REQUESTED BY MIDWESTERN STATE UNIVERSITY; DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, Sikes Lake is a recreational and educational asset to the citizens of Wichita Falls; and WHEREAS, Midwestern State University (MSU) controls 88% of the 21 acre lake and desires to see that it remain a viable asset for both the university and the community; and WHEREAS, engineering studies have estimated that the cost to dredge 90,000 cubic yards of silt from the lake would cost approximately $1,800,000; and WHEREAS, MSU has state and private commitments of approximately $1,330,000 thus far; and; WHEREAS, the Wichita Falls Sales Tax (413) Corporation voted unanimously on June 21, 2000 to recommend approval of this project and funding in the amount of $300,000. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The FY 1999 -2000 budget of the Wichita Falls 4B Sales Tax Corporation is hereby amended to appropriate $300,000 for the Sikes Lake Dredging Project subject to a commitment from the MSU Board of Regents that the lake will remain open for public use by adoption of a policy statement iri accordance with the attached Exhibit A, the same being a letter dated June 30, 2000 from Dr. Louis Rodriguez. SECTION 2. It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. Rodriguez, Su dent SUBJECT: Sikes Lake Project Listed below is the statement that will be reviewed by the MSU Board of Regents at their meeting on July 11, 2000. My recommendation is that they adopt this statement as policy. However, I certainly do not speak for the regents. We will have their response on July 11, 2000. It is the intent of the University Administration and the Board of Regents to make this developing community asset (Sikes Lake) a recreational facility accessible to the citizenry generally, regardless of University affiliation. We trust that your board and the City Council will recognize that as custodians of State of Texas property, we are charged with the responsibility of exercising reasonable management, oversight controls, and restraints over use of all properties for which we have responsibility. We must reserve for future boards and our successors the discretionary authority to discharge their responsibilities in meeting issues unforeseen by the University at present.
