Ordinance Granting A Variance Of Section 5430.8 Of The Code of
Ordinances Of The City Of Wichita Falls, Which Prohibits The Sale Of
Alcoholic Beverages Within 300 Feet Of A Property Line Of A School,
To La Michoacana Meat Market At 1508 Midwestern Parkway For An
Off - Premise Alcoholic Beverage Sales Permit
WHEREAS, the owners of LMMM Wichita Falls #1, LLC, d /b /a La Michoacana
Meat Market, are requesting a variance from the prohibition of the sale of alcoholic
beverages within 300 feet of a private school be issued to 1508 Midwestern Parkway;
and,
WHEREAS, the City Council, after consideration of the health, safety, and
welfare of the public and the equities of the situation, finds that regulation in this
particular instance is not in the best interest of the public, creates an undue hardship on
the applicant, and is not effective or necessary.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
A variance is granted of Section 5430.13 of the Code of Ordinances of the City of
Wichita Falls, which prohibits the sale of alcoholic beverages within 300 feet of a
school, to LMMM Wichita Falls #1, LLC, d /b /a La Michoacana Meat Market, at 1508
Midwestern Parkway, for the requested off - premise alcoholic beverage sales permit.
