RESOLUTION RESOLUTION TO ACCEPT THE 2000 ALLEY REHABILITATION
PROJECT AND AUTHORIZE FINAL PAYMENT TO MCGRATH
BROTHERS; FINDING AND DETERMINING THAT THE MEETING AT
WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE
PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls entered a unit price contract with McGrath
Brothers with the estimated total cost of $406,811.25; and
WHEREAS, the actual work was completed at a total cost of $402,931.08 of
which $385,617.60 has been previously paid to the contractor; and
WHEREAS, the Contractor incurred 17 days of liquidated damages with a total
amount of $4,080.00; and,
WHEREAS, with the deduction of $4,080.00 for liquidated damages leaves an
amount due of $13,233.48; and,
WHEREAS, the City Staff has inspected the work and found it to be acceptable.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The 2000 Alley Rehabilitation Project is hereby accepted, and the
City Manager is authorized to make final payment to the contractor.
SECTION 2. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
