RESOLUTION APPROVING THE ASSIGNMENT OF THE LEASE
AGREEMENT FOR BUILDING NO. 90, KICKAPOO AIRPARK TO
DARROLD A. CANNAN, JR., WAIVING THE CITY'S RIGHT OF FIRST
REFUSAL TO PURCHASE THE LEASED PREMISES, AND
AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY
DOCUMENTS; FINDING AND DETERMINING THAT THE MEETING AT
WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE
PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls, Texas, has a lease agreement with Craig
L. Estes for Building No. 90 at the Kickapoo Airpark; and
WHEREAS, the Lessee, Craig L. Estes, wishes to assign the lease to Darrold A.
Cannan, Jr.; and
WHEREAS, the assignment of the lease agreement requires City Council
approval; and
WHEREAS, it is in the best interest of the City to consent to the assignment of
the lease.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The City of Wichita Falls consents to the assignment of the lease
for Building No. 90 at Kickapoo Airpark from Craig L. Estes to Darrold A. Cannan, Jr.
SECTION 2. The City of Wichita Falls waives its right of first refusal to purchase
the leased premises, as provided under Article XI of the lease.
SECTION 3. It is hereby officially found and determined that the meeting at
which this resolution was passed was open to the public as required by law.
