AN ORDINANCE MAKING IT UNLAWFUL TO PARK OR LEAVE STANDING ANY
VEHICLE IN OR UPON THE RIGHT-OF?4AY OF U. S. HIGIEJAY NO. 281 'WITHIN THE
TERRITORIAL LIMITS WHICH ARE FULLY SET FORTH AND DESCRIBED IN THE BODY OF
THIS ORDINANCE, AND WHICH AREA IS ADJACENT TO SHEPPARD FIELD AND THE WK.
MCKINLEY TRACT ADJOINING THE SATE ON THE SOUTH - PROVIDING A PENALTY THERE-
FOR., AND DECLARING AN EMERGENCY.
11HEREAS many vehicles are now being parked in and upon the right-
of-way of U.. S. Highway No. 281 adjacent to and near Sheppard Field, and
are being allowed to remain so parked and standing for long periods of time,
thereby hindering the free use of Sheppard Field and creating a traffic
hazard and impeding the free flow of traffic along said highway and in and
out of Sheppard Field;
NOW, THEREFORE, BE IT ORDAINED BY THEE B01,20 OF ALDERMEN OF THE CITY
OF 14ZCHITA FALLS, TEXAS:
Section 1. The word "vehicle" when used in this Ordinance shall
be held to include every device in, upon or by which any person or property
is or may be transported or drawn upon a highway.
Section 2. (a) That from and after the passage of this Ordinance
it shall be unlawful to park or leave standing any vehicle on any part of
the right-of-uay of U. S. Highway No. 281 within the following described
area, to-wit:
Beginning at a point where the east right-of-way line of U. S. Highway
No. 281 (formerly known as U. S. Highway No. 70) intersects the south
line of Kell Field Municipal Airport; Thence in a westerly direction
across said highway and at right angles to the east line of said high-
way right-of-way line to a point in the west right-of-way line of said
U. S. Highway No. 281; Thence southeasterly along said west right-of-
way line of U. S. Highway No. 281 to a point which is west of the south-
west corner of the Wm. McKinley tract of land owned by the city of
Wichita Falls and now under lease to the U. S. Government, said point
being at the place where a prolongation of the south line of said Wm.
McKinley tract, out of blocks 6 and 7 of the McKinley and Simmons Sub-
division, as described in Vol. 360, page 307, Deed 11ecprds of Wichita
County, Texas, would intersect said west right-of-way line of said
U. S. Highway No. 281; Thence east to the southwest corner of the said
Wm. McKinley tract, the same being a point in the egst right-of-way
line of said U. S. Highway No. 281; Thence northwesterly along the
east right-of-way line of said U. S. Highway No. 281 to the place of
beginning; and being all the right-of-way in U. S. Highway No. 281
adjoining what is known as Sheppard Field and the said Wm. McKinley
tract so leased to the U. S. Government.
(b) This section shall not apply to the driver of any
vehicle which is disabled while in said area in such manner and to such ex-
tent that it is impossible to avoid stopping and temporarily leaving such
disabled vehicle in such position.
Section 3. Whenever any police officer finds a vehicle parked or
left standing in said prohibited area in violation of this Ordinance, such
officer is hereby authorized to move such vehicle or require the driver or
other person in charge of the vehicle to move the same to a position outside
of said prohibited area.
Section 4. Any person guilty of violating this Ordinance shall
upon conviction be punished by a fine of not less than One ($1.00) Dollar nor
more than Two Hundred ($200.00) Dollars.
Section 5. Whereas the above described area is one through which
heavy traffic now moves and the full and free use by the Government of Shep-
pard Field necessitates that the same be kept open and that large numbers
of vehicles are daily being left parked and unattended in such area, thereby
creating a traffic hazard and preventing the free flow of traffic, creates
an emergency on the ground of urgent public need for the preservation of
peace and health and of safety and of property, and the rules requiring
ordinances to be read on three several days is hereby suspended and this
ordinance shall become effective from and after its passage and approval
and publication as required by law.
