Ord 1522 6/26/1950 ORDINANCE MAKING AN APPROPRIATION FOR THE INDEBT- EDNESS TO BE INCURRED BY THE CITY OF WICHITA FALLS, TEXAS, UNDER CONTRACT WIT;:I STUCKEY CONSTRUCTION COMPANY AND SAID CITY FOR THE '=ryAKING AND CONSTRUCT- ING OF CERTAIN STREET IMPROVEMENTS ON A PORTION OF AVENUE K AND PORTIONS OF SUNDRY OTHER STREETS AND AVENUES IN THE CITY OF WICHITA FALLS, TEXAS, AND DECLARING AN EMERGENCY. WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas, has heretofore ordered that the hereinbelow mentioned and described portions of streets and avenues in said City be improved by raising, grading and filling same and by installing concrete curbs and gutters where same are not already installed on proper grade and line, and by constructing thereon a Seven Inch Flexible Base Course with One and one-half inch Texas State Highway Department Type Q-Modified Asphalt Pavement, together with incidentals and appurtenances, including concrete sidewalks and storm sewers and drains where same are shown and provided for on the plans; all of which said improve- ments are to be constructed where shown and in strict accordance with the plans and specifications now on file with the City; said Dortions of streets and avenues being as follows, to wit: AVENUE K from Polk to Santa Fe, SAVE AND EXCEPT those intersections of Avenue K with other streets which have already been permanently paved or improved, '.mown and designated as Unit or District No. 1; AVENUE U from Kemp to Grant, known and designated as Unit or District No. 2; SPEEDWAY STREET from Holliday to Bridwell, known and designated as Unit or District No. 3; TAFT STREET from Avenue H to Avenue J, known and designat- ed as Unit or District No. NORTH THIRD STREET from N. Broadway to Grand Avenue, known and designated as Unit or District No. 5; POLK STREET from Bullington to Kings Highway, SAVE AND EXCEPT the intersection of Polk Street wit, Talunar Lane, '_mown and designated as Unit or District No. 6; and, WHEREAS, bids were duly advertised for and received, were fully tabulated, canvassed and cohsidered and the bid. of Stuckey Construction Company found to be the lowest and most advantageous and was accepted by the City of Wichita Falls, Texas; and, WHEREAS, pursuant to such acceptance, a formal contract dated the _ day of June, 1950, for the construction of such improvements has heretofore been executed by Stuckey Construction Company and is now on file with the City awaiting - 1 - i I the execution by the City; THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: I. To provide for the payment of the indebtedness to be incurred by the City of Wichita Falls, Texas, by virtue of the contract hereinabove mentioned, there be, and is hereby, appropriated and set aside out of current revenues and avail- able funds for said purpose, an amount sufficient to pay said indebtedness so to be incurred. II. The present condition of said portions of streets and avenues to be improved endangers health and safety and the improvement of same constitutes an urgent public need for the preservation of peace, health and safety of property and it is necessary that said improvements be proceeded with while the weather will permit, and the construction of said improvements is being delayed pending t7ie taking effect of this ordinance, and such facts constitute acid create an emergency and an urgent public necessity requiring that the rules providing for ordinances to be read more than one time, or at more than one meeting, be suspended, and that this ordinance be passed as and take effect as an emergency measure, and such rules are accordingly suspended and this ordinance is passed as and shall be in force and effect immediately from and after its passage.
