Ord 1524 6/26/1950 ORDINANCE MAKING AN APPROPRIATION FOR THE INDEBT- EDNESS TO BE INCURRED BY THE CITY OF WICHITA FALLS, TEXAS, UNDER CONTRACT WITH STUCKEY CONSTRUCTION I COMPANY AND SAID CITY FOR THE MAKING AND CONSTRUCT- ING OF CER TAIN STREET IMPROVEMENT, ON A PORTION OF NORTH BROOK AVENUE AND PORTIONS OF SUNDRY OTHER STREETS IN THE CITY OF WICHITA FALLS, TEXAS, AND DECLARING AN EMERGENCY. i WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas, has heretofore ordered that the hereinbelow mentioned and described portions of streets and avenue in said City be improved by raising, grading and filling same, making and installing concrete curbs where not already installed on proper grade and line, and by constructing thereon a Six Inch Reinforced Concrete Pavement, together with incidentals and appurtenances, including siaewalks and storm sewers and drains where same are shown and provided for on the plans; all of which said improvements are to be constructed where shown and in strict accordance with the Plans and Specifications now on file with the City; said portions of streets and avenue being as follows, to wit: I NORTH BROOK AVENUE from center line of N. Third to No. property line of Lincoln, known and designated as Unit or District No. 7; NORTH FIFTH STREET from West curb line of N. Brook to paving on North Broadway, known and designated as Unit or District No. g; LINCOLN STREET from west property line of N. Scott to east curb line of N. Brook, SAVE AND EXCEPT the intersection of Lincoln Street with N. Lamar Street, known and designated as i Unit or District No. 9; PARK STREET from N. line Lot 14, Blk. 5, Boyd Add.. to center line of Flood, known and designated as Unit or District No. 10; HOLLIDAY STREET from So. property line of Fifth to No. property line of Seventh, known and designated as Unit or District No. 11; and, WHEREAS, bids were duly advertised for and received, were fully tabulated, canvassed and considered and the bid of Stuckey Construction Company found to be the lowest and most advantageous and was accepted by the City of Wichita Falls, Texas; and, WHEREAS, pursuant to such acceptance, a formal contract dated the day of June, 1950, for the construction of such improvementi has heretofore been executed by Stuckey Construct- ion Company and. is now on file with the City awaiting the execution by the City; THEREFORE, - 1 - BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: I. To provide for the payment of the indebtedness to be incurred by the City of Wichita Falls, Texas, by virtue of the contract hereinabove mentioned, there be, and is hereby, appropriated and set aside out of current revenues and avail- able funds for said purpose, an amount sufficient to pay said indebtedness so to be incurred. II. The present condition of said portions of streets and avenue to be improved endangers health and. safety and the j improvement of same constitutes an urgent public need for the preservation of peace, health and safety of property and it is necessary that said improvements be proceeded with while the weather will permit, and the construction of said improvements is being delayed pending the taking effect of this ordinance, and such facts constitute and create an emergency and an urgent public necessity requiring that the rules Droviding for ordinances to be read more than one time, or at more than one meeting, be suspended, and that this ordinance be passed as and take effect as an emergency measure, and such rules are accord- ingly suspended and this ordinance is passed as and shall be in force and effect immediately from and fter its passage.
