WHEREAS, the Board of Aldermen nf the City of Wichita Falls, Texas, has heretofore ordered that the hereinbelow mentioned and described portion of Roberts Avenue in said. City be improved by installing and constructing concrete curbs and gutters where same are not already installed on proper grade and line, by leveling up the existing surface and by resurfac- ing same with Texas State Highway Department Type 4-1,1odified- Asphaltic Concrete, and has heretofore ordered that the here- inbelow mentioned and described portions of Sullivan Street and Texas and Rosewood Streets in said City be improved by raising, grading and filling same and by constructing thereon a Sever_ Inch Crushed Stone Flexible Base Course with a One and one-half Inch Texas State Highway Department Tyne Q-Modified- Asphaltic Surface and by constructing and installing concrete I curbs and gutters where sa=a.e are not already installed on proper grade and line; all of said improvements to be con- structed together with incidentals and. appurtenances, including sidewalks and storm sewers and drains where same are shown and provided for on the plans; all of which said improvements are to be constructed where shown and in strict accordance with the Plans and Specifications now on file with the City; said portions of streets and avenue being as follows, to wit: TEXAS & ROSEWOOD from E. Scott paving to No. line of Gerald Street, known and designated as Unit or District No. 12; i SULLIVAN STREET from E. property line of Redwood to West curb line of Rosewood, known and designated as Unit or District No. 13; ROBERTS AVENUE from W. property line of Van Buren to E. property line of Sunset Dr. , known and designated. as Unit or District No. 1l+; and, WHEREAS, bids were duly advertised for and received, were fully tabulated, canvassed and considered and the bid of Stuckey Construction Company found. to be the lowest and most advantageous and was accepted by the City of Wichita Falls, Texas; and, WHEREAS, pursuant to such acceptance, a formal contract dated the � _ day of June, 1950, for the construction of such improvements has heretofore been executed by Stuckey Construction Company and is now on file with the City awaiting the execution by the City; THEREFORE, - 1 - BE IT ORDAINED BY THE BOARD OF ALDER4EN OF T'HE CITY OF WICHITA FALLS, TEXAS, THAT: I. To provide for the payment of the indebtedness to be incurred by the City of Wichita Falls, Texas, by virtue of the contract hereinabove mentioned, there be, and is hereby, appropriated and set aside out of current revenues and avail- able funds for said purpose, an amount sufficient to pay said indebtedness so to be incurred. II. The present condition of said portions of streets and avenue to be improved endangers health and safety and the improvement of same constitutes an urgent public need for the preservation of peace, health and safety of oroperty and it is necessary that said improvements be proceeded with while the weather will permit, and the construction of said improvements is being delayed pending the taking effect of this ordinance, and such facts constitute and create an emergency and an urgent public necessity requiring that the rules providing for ordinances to be read more than one time, or at :more than on meeting, be suspended, and that this ordinance be passed as and take effect as an emergency measure, and such rules are accordingly suspended and this ordinance is passed as and shall be in force and effect immediately fro and after its passage. R. Abbott, Alderman J. R. Ray, Alderman Lloyd C. Thomas, Alderman Berry Brown, Alderman Roy W. Parish, Alderman R. J. Brown, Alderman J. B. Hickerson, City Clerk Frank Wood, City Manager John B. I Alderman Berry Brown moved that the ordinance be ,placed on its first reading; seconded by Alderman Abbott and carried by the following vote: I AYES: Aldermen Abbott, Thomas, Parish, Ray, Berry Brown and R,. J. Brown NAYES: None. CARRIED: Ordinance placed on first reading. Alderman Ray moved that the ordinance pass first reading; seconded by Alderman H.J.Brown and carried by the following vote: AYES: Aldermen Abbott, Thomas, Parish, Hay, Berry Brown and H. J. Brown. NAYES: None. CARRIED: Ordinance passed first reading. Alderman Thor:as moved that the rules be suspended and that the ordinance be placed on second reading; seconded by Alderman i�ay and carried by the following vote: AYES: Aldermen A'obott,, Thomas, Parish, Ray, Berry Brown _ and R.
