BE IT ORDAINED BY THE CI'fY` COUNCIL OF THE CITY OF 6,FICHITA FALLS :
Section 1. 'That the IL"issouri-Kansas-Texas 7?ailroad
Company of Texas, its successors and assigns , be and it is here-
by --ranted the right, privilege and franchise to construct ) main-
tain and operate a spur track in, upon, over and across the Old
3urkburnett Road in the City of v1ichita Falls , '91ichita County,
Texas , at the location more particularly described as follows :
Beginning at the point of intersection of the
:westerly line of the Old 3urkburnett Road with the
i4ortherly line of iadison Street ;
Thence Northerly along said v'esterly line of
the Old Burkburnett Road 76 feet , more or less , to
a point distant 8.5 feet measured Northeasterly at
right angles from the center line of The Texas Com-
pany spur track-)
Thence Southeasterly parallel with and 8.5 feet
Northeasterly from the center line of said Texas
Company spur track 73-42 feet , more or less , to a
point on said North line of 1,,adison Street;
Thence Southwesterly along said North line of
adison Street 33 .58 feet , more or less , to the
point of beginning;
Containing an area of 1203 .5 square feet , more
or less ;
All as shown on print of drawing No. 3-2779,
Office Engineer Eaintenance of Way, Dallas , Texas ,
dated June 2, 1950, attached and made a part hereof.
Section 2. it shall be the duty of said Railroad Com-
pany, its successors and assigns , to, at all times, maintain
said road crossed by said spur track between the rails thereof
and for two feet on each side of said spur track at its expense.

assigns , shall save the city of Wichita Falls harmless from all
damages , or claims for damages, resulting from the construction)
maintenance and operation of said track constructed hereunder
or resulting from any operation of cars thereon.
Section 4. This ordinance shall take effect and be
in force from and after its passage.

Dear Sir:
With reference to the application of
the M-K-T Ry. Company for franchise to occupy a portion
of the old Burkburnett Road opPosite Mile Post 1.22, I
see no reason why this request should not be granted.
I therefore recommend that the franchise be granted to
the M K-T Ry. Company for the purpose stated.
