AN ORDINANCE CLOSING AND ABANDONING A PART OF THE ALLEY IN
BLOCK NO. TWO, INGLEWOOD PLACE ADDITION TO THE CITY OF WICHITA
FALLS, TEXAS; RESERVING TO SAID CITY A 10-FOOT EASEMENT FOR
UTILITIES, TOGETHER WITH ALL EXISTING EASEMENTS, IF ANY, NOW
LOCATED IN SAID ALLEY; PROVIDING THAT SAID CITY SHALL UNDER NO
CIRCUMSTANCES BE LIABLE FOR DAMAGES IN THE EVENT BUILDINGS ARE
CONSTRUCTED OVER EXISTING SEWER OR WATER LINES BY VIRTUE OF
THE MAINTENANCE AND OPERATION OF SAID SEWER OR WATER LINES;
AND DECLARING AN EMERGENCY.
WHEREAS, C. R. Cowles is the owner of all the lots adjoining and ad-
jacent to that portion of the alley herein closed and abandoned, and has
filed his application and petition to close and abandon the same, subject
to a 10-foot easement for utilities;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS:
That the following described portion of the hereinafter named alley
be closed and abandoned:
All that part of the alley in Block No. Two of Inglewood Place
Addition to the City of Wichita Falls, Texas, which is bounded
on the west by Lot 23 and on the east by Lots 19-22 inclusive,
according to amended plat of said Inglewood Place Addition to
the City of Wichita Falls.
However, the closing of said alley shall be subject to a 10-foot
easement along the east side of said alley for all public utilities and,
further, that all existing easements in said alley now held by said City
of Wichita Falls are hereby reserved, and subject to the further pro-
vision that if any building or structure is located over any existing
sewer or water lines that the City of Wichita Falls will not be liable
for any damages resulting from the operation and maintenance of such
sewer or water lines.
The fact that a large number of new dwellings are now being erected
in said addition and many other improvements are now being made therein
in order to meet the present acute housing shortage creates an emergency
and it is hereby declared that the foregoing ordinance is an emergency
measure, and tIze rule requiring the reading of this ordinance on three
separate days is hereby suspended and this ordinance shall take effect
immediately upon its passage.
