Ord 1560 5/28/1951 ORDINANCE NO. 156o ORDINANCE AWARDING AMID APPROVING CONTRACT WITH STUCKEY CONSTRUCTION COMPANY FOR THE BAKING AND CONSTRUCTING OF CERTAIN STREET IMPROVEMENTS ON A PORTION OF ALMA STREET AND PORTIONS OF SUNDRY E OTHER STREETS, AVENUES, ALLEY AND PUBLIC PLACES IN THE CITY OF WICHITA FALLS, TEXAS, RATIFYING AND CONFIRMING ITS EXECUTION, TAKING AN APPROPRIATION FOR THE INDEBTEDNESS TO BE INCURRED BY THE CITY OF WICHITA FALLS, TEXAS UNDER SAID CONTRACT, AdTD DECLARING AN Ei=IERGENCY. WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas, has heretofore ordered that a portion of Alma Street and portions of sundry other streets, avenues, alley and public places in the City of Wichita Falls, Texas be improved; and, WHEREAS, competitive bids for the making and constructing . of said improvements were duly advertised for in the manner and for the length of time and in the form required and provided for by the City Charter and the law in force and effect in the City of Wichita Falls, Texas; and, WHEREAS, bids were duly received, were fully tabulated, canvassed and considered and the bid of Stuckey Construction Company, Contractors in the City of Wichita Falls, Texas, was found to be the lowest and most advantageous and was accepted by the City of Wichita Falls, Texas; and, WHEREAS, contract was duly drawn and presented to the City of Wichita Falls, Texas and was, on the 27th day of April, 1951, duly executed by the City Manager of the City of Wichita Falls, Texas and attested by the City Clerk with the corporate seal of the City affixed thereon, as well as by Stuckey Con- struction Company; and, WHEREAS, said contract, among other things, fully describes the improvements to be constructed and the portions of streets avenues alley and;. , , y public places on which said improvements are to be constructed and said contract has been fully examined and found to be in all matters and things correct and proper; THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDER"LIEN OF TIC CITY OF WICHITA FALLS, TEXAS, THAT: E The contract for the making and construction of the street improvements described therein on those portions of E i - 1 -- streets, avenues, alley and public places therein enumerated and designated as Units Dios. 25 to 59 inclusive, be, and is '_Hereby, adopted and approved. II. The work of making and constructing such improvements and the contract therefor is hereby awarded to Stuckey Con- struction Company. IIz. The execution of said contract by the City Manager of the City of Wichita Falls, Texas, as well as the attestation by the City Clerk is hereby authorized, ratified and confirmed and said contract is hereby adopted as the contract for the construction of the street improvements described therein by and between Stuckey Construction Company and the City of Wichita Falls, Texas. IV. To provide for the payment of the indebtedness to be incurred by the City of Wichita Falls, Texas by virtue of the contract hereinabove mentioned there be, and is hereby, appropriated and set aside out of current revenues and available funds for said purpose, an amount sufficient to pay said indebtedness so to be incurred. V. The present condition of said portions of streets, avenues, alley and public places to be improved endangers health and safety and the improvement of same constitutes an urgent public need for the preservation of peace, health and safety of property and it is necessary that said improvements be con- structed while the weather will permit and the construction of said improvements is being delayed pending the taking effect of this ordinance, and such fact constitutes and creates an emergency and an urgent public necessity requiring that the rules providing for ordinances to be read more than one time or eft more than one meeting or that the ordinance shall not go into effect until thirty (30) days after its passage, be suspended and that this ordinance be passed as and take effect as an emergency measure, and such rules are accordingly suspended and this ordinance is passed as and shall take effect and be in force as an emergency measure and shall be in force and effect immediately from and after its passage.
