A AN ORDINANCE PROVIDING FOR PARTICIPATION IN THE TEXAS MUNICIPAL RETIiI� Pti7ENT SYSTEM BY T-T-E C.ITY OF WICHITA FALLS, TEXAS: PROVIDING FOR AND ELECTINrl TO HAVE ALL OF THE EMPLOYEES OF ALL DEPARTiv4ENTS OF THE CITY C70%7ERNYENT, EXCEPT TH 1a FIRE DEPARTMENT, PARTICIPATE IN SUCH SYSTEM: AND ACCEPTING ALL OF TTTE 03LICTATIONS AND BENEFITS OF SUCH SYSTEM. 10JTEREAS, the Constitution of the State of Texas was amended on November 7, 1944, by the addition of Section 51-f, Arti- cle III, which authorized the Legislature to establish a State- wide retirement and disability pension system for city employees; WHEREAS, Chapter 75, Acts 50th Legislature (1947) as amended by Chapter 24, Acts Remular Session 51st Legislature (Ver- non's Civil Stats., Art. 6243h) established the Texas Municipal Retirement System, and authorizes the governing Body of each city or town to elect, at its option, to have one or more of the city departments participate in such system; and 11FTEREAS, municipal employees are not covered by Federal Social Security, the governing body of the City of Wichita Falls, Texas, finds that it will be in the public interest for the city to have its employees participate in the Texas Municipal Retire- ment System, now therefore; BE IT ORDAINED BY THE BOARD OF ALDER IEN OF uVICHITA FALLS, TEXAS : Section 1. 'That, on behalf of the City of Wichita Falls, Texas, the Board of Aldermen hereby exercises its option and elects to have the city and all of the employees of all departments, except the fire department, participate in the Texas Municipal Retirement System as provided in Cha ter 75, Acts of the 50th Legislature, as amended, being Article 620h of Vernonts Annotated Civil Statutes; and all of the benefitis and obligations of such system are hereby accepted. Section 2. That the City Manager is hereby directed to notify the 30ard of Trustees of the Texas HluniciiRl Retirement System that the City of Wichita Falls, Texas, has elected to parti- cipate and have the employees of the following city- departments participate in such system: Police Department, Department of Pub- lic works, Public Safety, General Government, Conservation of Health, Recreation and Cemetery, Sewer and hater. Section 3. Each person who becomes an employee of any par- ticipating department on or after the effective date of participation of such department shall be included within and subject to the pro- visions of the Texas Municipal Retirement 'ystem beginning upon the date such person becomes an "employee" as defined in sub -section 14, Section 2, of such system. Section 4. That the City of -Wichita Falls, Texas, may in the future refuse to add new departments or new employees to such system but shall never discontinue as to any participants. Section 5. That the City Clerk is hereby directed to remit to the Board of Trustees of the Texas Municipal Retirement System, at its office in Austin, Texas, the city's proper contri- butions to the system and the ar.^.ounts which shall be deducted from the compensation or payroll of employees, all as required by said Board under the provisions of Chapter 75, Acts of the 50th Legis- lature of the State of `texas, as amended, and the said City Clerk is hereby authorized and directed to ascertain and certify offi- cially on behalf of the City of Wichita Falls, Texas, the prior service rendered to the said municipality by each of the employees of the participating departments, and the average prior service compensation received by each, and to ma?ke and execute all other reports and certificates, which may be required by the City of 'Nichita Falls, `Texas, Under the provisions of Chan_ ter 24, Acts Regular Session 51st Legislature or the rules and regulations of the hoard of Trustees of the Texas )Municipal Retirement System, PASSED AND AFZiOVED this the th day of January, 1952.
